From what I understand, there is a little known clause where when a new "law" (i.e. Obamacare) is enacted, timelines can be arbitrarily drawn to enact the said law.

Dear beezzer,

You're right about the timelines. The problem comes in when the law specifies certain steps by certain dates. Obamacare does, which is why the Administration is saying "We won't prosecute you for not obeying the law."

How the hell can Obama proclaim an extension?

By ignoring the "US Constitution". He's done it before.

Since when does the executive branch have the authority to rewrite laws?

It doesn't! But that doesn't matter to Mr. Obama, or his followers.

When did we gain a Caesar?

Shortly after the 2008 Presidential election.

The whole thing is about Article 2 of the Constitution.

The fine line Obama walks with 'enforcement discretion' might be based on a President's right to grant a pardon.

Complicated. We need to research.

but here is an article addressing the problem and the abuses.

The President Does Not Have a Constitutional Power of Prosecutorial Discretion: Part I (part 2 is at the bottom...click)

The Congress ordinarily has a power to mandate the execution of a law. Judge Kavanaugh writes that “prosecutorial discretion does not include the power to disregard other statutory obligations that apply to the Executive Branch, such as statutory requirements to issue rules, or to pay benefits, or to implement or administer statutory projects or programs.” And certainly this is correct. It would be very surprising if the President could choose not to pay someone their social security benefits. If Congress passes a law that mandates the closing of a prison, that is required. If Congress passes a law that requires the executive to issue a particular regulation, it must do so.

So what is different in cases of prosecutorial discretion? (Before exploring this question, let me add that one can draw a distinction between federal civil laws and federal criminal laws. Are people arguing for prosecutorial discretion as to criminal actions only or also for civil actions? It is not clear what they arguing, but the arguments might differ somewhat. For now, I will largely focus on criminal violations.)

Can I get a double face palm? Maybe if it's not too much to ask a quadruple face palm? I called it a couple of days ago and said that Obama could fix all of this, but it would be highly frowned upon. Maybe our dictator in chief reads ATS?

Des, I just want to point out, it's not a 12 month fix.

Obama stated 2014. AFTER the mid-term elections, before the fixes are over.

Even with "All the king's horses and all the king's men", I don't believe King Obama can "fix all of this" again. He missed his chance when he refused to negotiate with Republican Representatives, and chose to shut the Government down, instead.

Thank you for pointing that out to me Beeze...and it's not a fix at all. It's a stay of execution.....

Ok, maybe I used the term "fix" a little too loosely. What I said for a fix would be to eliminate the wording in the grandfather clause that caused the expiration of existing policies, and he just said he wouldn't actively prosecute the insurance companies for 12 months. Not exactly what I said, but along the same lines....sort of.

Insurance companies are crying about the "delay", because now they think that those that the insurance companies need the most, "The healthy and able" will stay longer with the "pre ACA policies" this sure will make the pool for the covering of those with pre existing conditions less profitable

But the insurance companies will not come out and tell you that, right?

The white house's Obamacare fix is about to create a big mess

The concern here is that healthier people are more likely to stay in these pre Obamacare plans; The're probably more okay with skimpier benefit package And that could drive up premiums in the new Obamacare markets.

www.washingtonpost.com...

So be warned that premiums will be more expensive that they already are because the Obama "delay".

Agreed, I also said a fix would be too little too late, I was just saying that this is pretty much the fix that he could do, not that it would save him or anyone involved. I can't express enough disdain for this law to make it clear to everyone how much I dislike it.

Now the administration had 3 years to do Obamacare and it failed.

Obama has given the insurance companies 31 days to fix Obamacares mistakes.

If they couldn't get it right after 3 fu##ing years, what makes them think that they can repair it in 31 fu##ing days?

Well it seems that "Obamacare" has become from the signature law that would make Obama stand out in history as his accomplishment to the biggest embarrassment of his Political career along with those in his political party.

But like I said before, he will rather create a bigger mess than forfeit

What if it was never meant to work? What if this was meant to be the biggest cluster F in history to be a doorway to something much worse? This may just be wine and conspiracy loon thinking out loud, but it does kinda make sense if you really step back and look at it all in perspective.

That is what many conspirators think, that ACA is mean to fail to bring back Obama first choice before the "Tea party" got involved and call it "socialism" making the" littler children" run scare.

Remember that the first choice was a free healthcare system, but big corporate insurance companies and their minions Politicians would never allow that to become reality.

I guess we will find out soon enough.

ok I've thumbed through all the posts ,so what is the general concensus? will millions be left uninsured for an indefinite amount of time? Or will Obama-care(less) be shoved down America's throat ?
