Federal Judge Overturns Ban on Openly Carrying Guns in Public.

In a quintuple victory for Second Amendment rights, a federal judge last week overturned a ban on carrying handguns in public, a ban on so-called assault weapons, caliber restrictions for long guns, a $1,000 tax on handguns, and a requirement that all guns be registered with the government.

"The individual right to armed self-defense in case of confrontation...cannot be regulated into oblivion," declared Ramona Manglona, chief judge of the U.S. District Court for the Northern Mariana Islands.

Judge Ramona Manglona is a chief judge of the U.S. District Court for the Northern Mariana Islands, a commonwealth of the United States.

The 9th Circus (which includes the Northern Mariana Islands) ruled that there is no Constitutionally protected right to concealed carry (WTF).

However, they did not address whether someone can open carry. Meaning, whether or not someone has a right to self defense beyond their front door.

But Judge Ramona Mangola did render an opinion:

..."the Second Amendment, based on its plain language, the history described in Heller I, and common sense, must protect a right to armed self-defense in public."

But wait, theres more!

Not only did she acknowledge an individual's right of self defense, she SHOT DOWN their ban on "assault" rifles.

She SHOT DOWN their ban on calibers larger than .223

She SHOT DOWN their gun registrations.

She SHOT DOWN their $1,000 tax on handguns stating, "The power to tax is not just the power to fund the government, it is the power to destroy."

I smell a Libertarian.

Those are some pretty unequivocal terms.

Of course this won't matter to revisionists and anti gun zealots.

They think prohibition works as long as its their form of prohibition.

Never thought I'd have to sit here and applaud a judge doing their job- protecting one of the basic defining rules of this country.

I suppose, though, that at least they ARE doing their job, which is a nice change of pace

More people NEED to use Amendment 9 (IX) to protect the 2nd Amendment. Read my sig.

This is from October 5th. I think the case was more concerned with a handgun ban in the Mariana Islands and a large tax on handgun ownership. Which is fine. The tax was incredibly excessive and an all out handgun ban is ludicrous.

She upheld the limit on 10 rounds in a magazine.

I disagree if she thinks guns need not be registered.

But this only seems to change laws in that commonwealth.

Its our poor educational system. Its an easy to understand right when we understand the 2nd, in the context of historical justification as examined in the Federalist Papers and as a right then among the others for securing ourselves against the abuse of government, just to name one offender mentioned.
