I agree with u wrabbit , but here is what baffling me .

Why haven't they prosecuted them?

I mean ones who were captured have to be guiltily of "terriorism" or terrorist acts out side their country.

Otherwise their detention is illegal.

But if their status is POW then that's a different story.

Imagine for a minute that let's say Russia came and started taking american mercenaries out of the US and held them captive on suspsion of terriorsim.

Just saying .. If they (the terrorist ) committed crimes in their own countrys well than their country needs to deal with them.


What's even worse is that the innocent detainee's are being subject to torture ..its sad really..

The first irony of your post is that you could happily practice Christianity in the very vast majority of Muslim countries. There's 2.5m Christians in Pakistan, for instance... who go about their business almost entirely unmolested.

The second - and perhaps biggest - irony is that you think America is the only place where people are free. People are 'free' by American standards in the very vast majority of the world. There's barely any 'freedoms' that Americans enjoy that aren't shared by virtually everyone in the First World, and also much of the Developing. Some of the Third World too, if we're honest.

Most first world countries don't spy on their citizens quite as widely as America though.

I would probably argue that this deal isn't a good idea - albeit without knowing the ins and outs.

However - much like the POWs in Cuba suddenly being Enemy Combatants, I don't think America is shy of changing the terminology when it suits.

This deal was probably orchestrated with 'an important Afghan political faction' rather than with 'terrorists'.

You dont trade a Muslin convert deserter for 5 of the Taliban top guys without there being a hidden agenda. why is he so important????
Maybe the 5 guys were part of a bigger deal, but they used Bergdahl as a cover.

Afghanistan isn't really in the Middle East and 'POW' refers to any enemy combatant who is held in custody during an armed conflict.

Bergdhal will have been 'arrested' by the correct authorities as some part of his capture - possibly by a corrupt official - but his formal arrest is part of the official process where America was informed that the Taliban was holding him. To assert authority, it was important that the Taliban are as 'legal' as possible.

Everyone who has ever been held at Guantanamo has been formally arrested.
