Foreclosure - I am Losing My Home Today

I do feel for you but that is only because of your son. The poor child.

But for you, this is life....nice guys are a joke and deserve to finish last. Plus, with your home on the line, you should of doubled your efforts to get the paper work in on time..NO EXCUSES.

You have unfortunately let your family down BUT it could be the chance for a new lease on life. Meaning, real people TAKE what they want...not wait patiently for it to happen.

As most people on here know...I worship Lucifer. All your prayers prove that there is NO god....or not one willing to help the righteous like yourself.

BTW, I feel for you. My parents were trapped in a similar situation. They even tried getting a modification, the same one the Obama fans and administration claimed would help the people, yet the banks are within the law and don't have to abide by it. They just ignore your requests, even if you hire a lawyer, and at the end only offer foreclosure...

Luckily my parents were able to stop them from foreclosing their home and are now up to date on payments, except that they owe more than the condo is worth...

What the .... In what country do you live?
The company can just claim to not have received your letters? Does your postal office not offer something like a letter for 3$ that returns a confirmation back to you?

Seriously, if any company, the biggest bank or the tiniest Second-Hand-Store here in germany would claim to "not have received the letter", they would be in BIG trouble if you had the confirmation of your post office that it was delivered.

Also, you missed 2 payments, even tried to contact them about it and search for a solution and they just can say no? Not a chance at all in my country, seems like the U S of A is not as great as i thought. If I was in your situation (here in germany of course, with the law on my side) I would get a lawyer and sue the crap out of them.

Make the bank produce the original mortgage paperwork. If they can't produce it (due to the mortgages being bundled, cut into pieces and sold over and over) you may have a case for staying put. I have heard of people going to court and asking for proof of the note and the bank could not produce it.

The worse part is that in order for most banks to give you a modification lawyers say that you should not pay the mortgage for a few months. They tell you it is risky but it is the only way to get banks to accept modifications, but what banks do is just ignore your requests, they lose your paperwork, even paperwork sent by lawyers and make you either continue to pay your old mortgage, or to foreclosure the home...

All this "Obama modification thing" was a SCAM, and a LIE...

Bottom line is this, We read 1 side of the story, there is always 2 sides. It doesn't matter what personal issues you have going on in life you have to pay your bills, and that includes your mortgage payments. You signed the agreement when you bought the home. All the sad excuses and stories does not stop the fact that you are the one who defaulted on making your payments. Your on a computer, you still paid your internet bill obviously. So you should have paid your mortgage payments.

I'm tired of people telling their 1 sided story to gain sympathy from others. It usually always revolves around well my kids sick, or my dog died. Come on people pay your bills and stop making excuses of why you lost your homes. It's everybody's fault but there's..Always you ever noticed. Dig for cans, collect glass bottles, you do whatever it takes to keep your home. Being by a sick child's side at the hospital is not going to make things better for him or her if they have no home to return too!

Accept the consequences for your're actions, Not blame everybody else for whats happened in your life!

First off, he wasn't blaming anyone. He was discussing why this happened. This could happen to you too. Don't think it can't. You don't know what life is going to throw at you.

Second, who leaves a four month old baby in the hospital 24/7 when it is sick? You actually expected the mother to just let the nurses there take care of it so she could go out collecting cans and bottles to save the home? If people were making money off cans, no one would be homeless.

Third, obviously you have had good luck in your life and have been blessed and never had to face down a situation where you choose between making a house payment and paying medical bills so you or your family can continue receiving treatment.

There were so many ridiculous things in your response, but most of all you come across as pretty heartless. When you drop from a heart attack, and can no longer pay your medical bills or house payments, or lose your home to a fire and are out on the street, please do not come to ATS and complain about it.

Yeah, It's sucks. I went through it last year but mine was due to being off work for a year with 2 back surgeries.

I hate to heap more gloom onto your story but I wanted to mention something many MAY not know about foreclosures, I didn't till this spring.

( I am going to make up numbers here for simplicity sake)

1. Your house is foreclosed on and lets say you owed $100,000 on it when they take it.
2. The bank ends up selling it for $60,000.
3. The $40,000 difference is considered income by the IRS and you have to pay taxes on it.

I didn't know this till tax time this year but found out real quick.

The very first question on the form was: Did you have a foreclosure last year?.....

I owed $160,000 on the house and they ended up selling it for $58,900 so I owed tax on the $101,000 difference. I am NOT sure of the total yet because we are still in the process but needless to say we are screwed.

ALERT.....................We can no longer go about business as usual. We need to rethink how we are now currently doing "business" and "govern".

We need real change not empty promises and fancy words by fancy Ivin Jivins in fancy suits that give our money to the banks and military.

It is time for some real change people, but it will take a poop load of courage.

That would be a good idea, except for the fact that UN's Agenda 21 is going to be implemented in the U.S., and under this law NO ONE would be able to own any land "for the good of all and mother Earth"... People will be herded into the cities, and cities will continue building upwards, with smaller apartments so that everyone can fit in...

Very sorry to hear. I have family currently that have to move because of the same issue. They are having a hard time finding a new residence before their time limit. So, I've been looking ways to help. For advice to check locally with your community action, charity, church organizations, etc. even though most are very swamped at this time.
Hopefully family/friends can help you as well. Rentals as most are there and have been there can be a real pain and can be very costly. Look into rent to owns(which may be harder in your situation), tax sales, etc., or even housing.

I know this may sounds crazy...But come to England i'll meet you with open arms, Plus the medical for your boy and your selves will be free , Like someone else said "IF I had the money I would buy your house and give it straight back to you!".

it's gonna be a little tight with 7 of us here, but by all means feel free to stay with us for as long as you need to. i cant imagine a family with little ones being homeless. there's work to be found here in south Jersey, if you look hard enough. c'mon up brother.

I have to say, I left yesterday feeling a deep and disturbing feeling of impotence and anger. I start today, after reading your story, with a deeper more pronounced form of that indignity. I am just......ready for whatever. We have no choice. I will not mention my problems but needless to say unless things change I might find myself in a similar situation. I have time, and hope. Two things that are running about as thin as our faith in this system we live in. It has failed us but more to the point, it is criminal and full of malice.

I hope this man and his family find the grace they need. I hope they overcome the hardships again and rise stronger for it.

Our leaders have done more than fail us. They didn't just accidentally run us over. They aimed a big rig at us and stepped on the gas.

I now understand in a way I never have before, the motivation of our founding fathers. The world governments are leaving their people with no choice. I say no choice since this is becoming insufferable. Pseudo slavery is not on the table.

Tell the bank that you own the house, not them. Tell them to show you the note to prove the house belongs to them. Tell them the only way you are going to leave is if they show you the note..... Good luck.
