Iraq war illegal or legal?

I had a talk with my civics teacher about how the iraq war was illegal and she said its kinda 50/50 because congress passed afganistan but they "approved"
but didn't "sign" the bill to go into iraq so doesn't it make the iraq war illegal?

well i guess it depends on who you ask...

in terms of US law the president and congress can pass what ever laws they need to make it "legal"

in terms of International law and the UN and binding treties and conventions

Here is the evidence to show you and your teacher that it is ABSOLUTELY illegal.

Section 8. The Congress shall have power to ... To declare war, grant letters of marque and reprisal, and make rules concerning captures on land and water; "

Has Congress declared war? Simple yes/no question.

The thing about legality of war, is that you cannot use the aggressors own laws in figuring out if it was justified.

Example:

Nazi Germany declared it legal to invade Poland, Netherlands, France..
Does this mean it was Legal, hell NO, infact the USA prosecuted it.


Therefore, dictating the war is infact 'legal' because Congress says so has as much weight as a hollowed out feather. If its Legal for America in 2003, its Legal for Germany in 1939.

The United States broke basic international LAW!
It attacked and occupied a nation, to which HADNT attacked them.
It created false evidence to trick and manipulate other nations into believing the accusations put forward.
It broke its own laws by blowing CIA agents covers, by spying on its citizens, by lying to its citizens and by IGNORING the will of the people, by destorying evidence and by blatantly ignoring subpeonas.

No matter how much of a traitor some people chose to be, it can never be said the IRAQ WAR was legal.
You only need to look at the ACTIONS, of the United States government to see they are well aware of this too!

No the Congress did not declare war. They authorize the war which is the power they gave to themselves when they passed the 1973 WAR POWER ACT.


section 4(a)(1), whichever is earlier, the President shall terminate any use of United States Armed Forces with respect to which such report was submitted (or required to be submitted), unless the Congress (1) has declared war or has enacted a specific authorization for such use of United States Armed Forces, (2) has extended by law such sixty-day period, or (3)

Have any of you actually bothered to READ the constitution? Those Dipsheeps in Congress ALREADY HAD THAT POWER.

Read it sometime. You might just learn something.

It was legal. Saddam had broken the cease-fire agreement from the 1991 Gulf War......technically that war had never ended.....only a cease-fire was in effect. Since 17 UN resolutions were ignored by Saddam the US had the right, under the cease-fire agreement, to re-start 'hostilities'. The decison to remove Saddam was not not due to the acts purportrated on 9/11 but after 9/11 the US saw that Saddam could be a threat in the future and after 17 failed UN resolutions.....the US saw that the 'world' community was a paper tiger and decided to void the 1991 Cease-Fire agreement and remove Saddam.

Yes, they did. But due to our involvement in Korea and Vietnam where Congress chose not to adhere to the Constitution by allowing our involvement without a declaration, Congress chose to write up the 1973 law to reclaim those powers. The Constitution says Congress makes the laws so this 1973 act is binding.

I have read it and I have learned something...but thanks anyway.

it was absolutely 100% illegal.

as has been pointed out, the decision of a particular government weather or not to go to war is no guideline as to its legality.

OP, i have got to say, your civics teacher is a f***ing moron, an argument stating that the US government may have had the right to invade iraq because the US government sort of authorized it is just about the dumbest thing i have ever read.
