This could be good because that act could bring the two sides a bit closer together eventually. And a pardon does not clear the crime, it only commutes the sentence. It would leave Trump unable to hold office, but he would stay out of prison.

How would you take Biden pardoning Trump?

I read an interesting analysis today that might give a strong indication how the 11th Circuit will rule in the full appeal.

In their ruling for the partial stay, the 11th Circuit cited US v. Chapman. This was a case that the 5th Circuit ruled on in 1977 that basically says that if a plaintiff doesn't meet the first Richey factor, then the court does not have equitable jurisdiction.

In Cannon's court, both Trump's lawyers and Cannon acknowledged the fact that Trump had failed to meet the first Richey factor. So what is the first Richey factor? Being able to demonstrate that the plaintiff's Constitutional rights were callously disregarded by the DOJ.

So why is the 11th Circuit citing Chapman interesting outside of the fact that it means that the court sees no issue with the warrant? The fact that the DOJ did not cite it in their initial filing. So the 11th Circuit are pretty much saying, unprompted, that Cannon did not have the jurisdiction to make her ruling.

As a result of the 11th Circuit introducing the Chapman precedent to the case, the DOJ cited it a number of times in their most recent filing for the full appeal. But I would say that the 11th Circuit already has a good idea how they'll be ruling next month.
