A PAEDOPHILE walked free from court after a judge accepted his 13-year-old victim had led him on.

David Barnes, 24, engaged in cyber-sex with the schoolgirl and downloaded hundreds of pornographic pictures and short films - one of which showed the rape of a handcuffed five-year-old girl.

He admitted 17 charges of making indecent images and one of inciting a child to engage in sexual activity.

But when he appeared before Judge Peter Fox for sentencing at Teesside Crown Court, in the north of England, he was allowed to walk free with a suspended sentence.

What is wrong with our Judges in the UK?

This pervert's probation officer handed the Judge a report which said he was a danger to children, but this judge said the 13 year old girl seduced him


How would you feel if a Judge publicy said that your 13 year old daughter seduced a 24 year old grown man?

And now this 'man' is allowed to go out and be seduced by other wicked children.

This judge isn't firing on all cylinders.

Although he is guilty and yes he should be put behind bars, 13 yr olds are quite capable of seduction.

Teen age girls are more aware of their sexuality these days and if you look around you, many are sexually active.

I don't buy the argument that a 13 yr old girl doesn't know what she is doing. She may not be aware of the consequences but many know exactly what they are doing and think it's the 'cool' thing to be sexy.

But he is a 24 yr old man and he is the one that knows the consequences more than anyone.

Do not pass GO...Do not collect 200...Go directly to jail.

And if I had my say...Both can spend a little time behind bars. If she wants to act grown up, she can pay like a grown up.

Period.

The judge makes me sick.
Its no wonder these scumbags keep re offending if this is how the justice systems treat them. These people are the lowest form of human beings, and its a shame the the rest of us have to share this world with them.
All peadophiles should be castrated.
And the judge should lose his job.

Clearly the judge has some leanings towards the very young himself if he is willing to buy that line of argument.

Its amazing that some people ever make it to the bench with some of the sick rulings you see.

Dude, we don't go around throwing kids in jail. The guy knew what he was doing was wrong and he should pay the consequences for his actions. But demonizing a 13 yr. old kid, that goes beyond the pale.

She'll learn about life's hard lessons soon enough, but we can't place her misguided actions and lack of maturity on the same level as a grown man. There's a distinct difference there.

I agree that many 13year olds are sexually active and know what they are doing, and I also agree that they may not understand the consequences - and this is the reason they have to be protected from perverts like Barnes.

Young girls barely in their teens are very aware these days, but they are also easily led because they are still children, and it was up to this adult paedophile to keep his slimy hands off her.

A night in jail will show her what adult life is like.

She's 13! The age of 'Should we treat her like a child...or as an adult?'

If she wants to play at adult games, she should play at adult consequences. I'm not saying a jail term...just a taste.

The adult however, should be put in a closed room with the girl's father. 30 minutes should do it just fine. Then, off to jail.

It's impossible to expect the same level of comprehension from a child as it is from an adult. When she is older and hopefully a bit wiser she will have to come to terms for her actions.

The judge had to make sure there was room in the prison for all the pot smokers and the REALLY bad guys; the folks who videotape law enforcement officers.

Its a shame that, when given the opportunity to put behind bars a man who is a real threat for society, the judge chooses instead to let him go on the grounds that the child was responsible for the actions of an adult.

I totally agree.

However, 30 years ago crime and punishment were very different compared to today.

30 yrs ago, young girls acting like this were a rare case. Now, because of what teenagers are exposed to on a daily basis, times have changed. And so the way we try to get a message across to them has to change.

Seems like kids have no respect for parents or authority anymore. They are pushing the boundaries further, committing crimes more violently, doing harder drugs and not caring about what parents or guardians say.

Unfortunately, it's a sad fact but it is just that... a fact. What do you do for punishment these days?

Spank them? Illegal

Talk to them? Don't want to listen.

Ground them? Ain't gonna work.

Send them to bed without supper? Old, antiquated and illegal.

And on and on.

If you try to talk to them and they don't want to listen, you can't do anything if they get up and walk away. Grab their arm? Illegal.

I know it's generalizing and not all kids are like this but sadly, a lot are.

My last say on this is that when spanking was made illegal, we lost our kids.

actually this is very true.

a long time ago when I was 21, I was
dating an 18 yr old girl. The 18 yr old
had a younger 14 yr old sister.

One night while over at her house,
we were sitting on the couch and I
told her to get ready, take a shower
that we were going out and she left
me on the sofa.

While she was in the shower, her 14 yr old sister
came into the room where I was and sat down
on the couch beside me. And without me
saying a word, she turned sideways
toward me on the couch, pulled up her dress
leaned back and revealed no panties and she
asked if I wanted any of that.

I refused of course, but still the experience
told me that yes, young girls can seduce
older men cuz one tried with me.

So if the judge made this determination
then I am sure he knows details of this
incident that we do not.

ALl of the discussions aside concerning a 13 yr old brain functioning on the same level as a 20-something, parents not paying attention, blah blah blah.. there is NO MAN ON THE PLANET that isnt aware of the age of consent in his state, country, etc. They all know.. this one and many others dont care. If there is any question of age.. a normal functioning man would back off. We are human beings and regardless of what a person is wearing or doing, we have the ability to walk away. No man in his right mind would get that close to a 13 yr old in order to be seduced unless he was there to be seduced.

Im with Getreadyalready up there.. Id have begged the court for leniency and set my husband loose on him. I can tell you he would no longer be in any position be seduced by children any longer.

It is true that many ask for trouble by wearing these things they do so young and all of this hypersexualization of children.. but everyone has a choice concerning their own actions.

Sympathy goes a long way in a world of relationships.

It is as simple as the judge justifying his own behaviors be letting this guy go.

And again I will state that this man should be castrated and hung by his thumbs. But, I will never agree that the girl was not a willing participant. In fact the post says that she was.

So, he gets punished...what does she get? Her cell phone taken away for a week?

Give me a break!

Of course, we all know that I would hope. My grandmother was married at 15.. so Im not ignorant of what you keep posting.It is also not the reality of today obviously. Children werent children until the age of 18 in the past.

The issue is the law. He broke it regardless of her participation he could have walked away. He chose not to. Ignorance or seduction is no excuse.

I think we are agreeing on the same thing here.

Yes, Law is Law. Agreed.

But if she is 50% guilty, what's her punishment? Nothing. So what stops her from doing it again? Nothing.

We have all heard of cases where a man gets charged for statutory rape only to find out that some 15 yr old girl had a fake ID and was sitting in a bar when they met.

What does the law do in this case? Punish him and send her home to momma.

Not right IMO.

I know it's a difficult subject but I am tired of treating kids like they are precious little snowflakes when so many of them are clearly not.
