Below is a letter to the Davie Police department in florida.. My father was arrested on a felony charge of Obstructing justice w violence, My father in his 50 plus years plus has never commited any crime whatsover and has never been charged with anything exept for a few minor traffic citations. yesterday on a Sunday evening officer #862 liberto jr James forced himself inside my fathers home without a warrant.. and then arrested my father and punched him 3 times for reserving his right to remain silent and for advising my sister to do the same.. The investigation was due to a dinged door incident, which hardly constitutes an emergency which would give the officer the legal power to not have too obtain a warrant to force himself into a home.. This department has gone too far and so has many in trampling our constitution!!! enough is enough!!! this incident occured on a sunday afternoon and there were two witissses inside the home when this occured.. and to all pro law enforcment ats members I will remind you not only is my family heavily in the military but also law enforcement in jurisdictions very close to the city of davie... All are appalled at what has occured, my father now has blurred vision because of the punches he received in the back of the neck.. all for a car door..

This letter is general complaint regarding the state of affairs at the Davie Police Department. Since this is an ongoing legal issue I will abstain from using any particular person or events.
I have noticed your department uses the designation “MAJOR” coupled with various events that support the armed forces , Then I will assume that the Davie PD considers itself aligned with the U.S Armed Forces in the battle to fight terrorism and to keep terrorist from taking our freedoms.. But what gives the United States of America freedom? What is it that has kept us from going into tyranny? The answer is the U.S constitution. Which was enacted to protect us againts againts tyranny. Right now over 3,000 soldiers have died in Iraq and afghanistan fighting for our freedom , and thousands more injured or mamed in the line of duty.. Yet it seems the Davie Police department has and is consistently trampling on these freedoms. When the U.S was in in its infancy and the redcoats were conducting seizures and raids on the colonists homes WITHOUT probable cause this is what inspired this part of amendment of the U.S constitution: Amendment IV
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
When joining the armed forces one must swear an oath to the consitution( I am sure your pd does not swear this oath) which is this:

I, (NAME), do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. So help me God.

I come from a family full of USMC service members who have fought and sacrificed there lives to keep our freedom, it seems however you department is at odds with what the U.S military stands for which is protecting the constitution from ALL enemies foreign and domestic. Due to recent events I believe your department is not abying by the constitutionof the United States but in fact consitently disobeying it.. I remind you that this country was formed on the basis of the constitution and as a result millions of service members have died for this “piece of paper”. I ask you to contemplate this. Do you really honor our fallen service members? Is your Department really alligned with U.S armed forces goal to fight for freedom? If not then your department in the end is no better then the redcoats we fought in the revolutionary war, no better then the Nazi’s and the japs we fought in World War 2, and now no better then Al Queda and Osama Bin Laden which we are fighting now.

This reeks of corruption and the police to enter a home without a search warrant cannot enter a home without one unless there is an imminent danger occurring within the residence. The term used is "exigent circumstance". The police assaulted him within his residence after he asked the officers to leave he was forced to stay quiet as if there was a crime being committed within the house when in truth there was not. When somebody is asked to leave a house no matter who it is and unless there was felony or a crime committed that has put someones life in danger the police, FBI, even the president is committing a crime by trespassing on private property. I believe the police have been trained in home invasion and are prepared when the time comes to forcefully take people out of their homes and this is very apparent in this situation that you have presented before us. I will be calling Davie Police and giving them a piece of my mind. I will go ahead and also send a letter to the chief of police regarding this issue. I believe this post because I on a number of occasions have encountered this very same thing happening within my neighborhood in Orange Park, FL. The police have boundaries and when they cross those boundaries they are just as scum as the robbers and murderers they put into prison and deserve to be fired just like any other person breaking the rules at any other job in the country. Now if the entire police force is committing similar crimes then that is a whole different situation that needs to be investigated by a higher force such as the FBI.

The police and government are out to destroy, and there is hardly any terrorism(fact). People should always be aware that the government is more dangerous to anyones life.

I only know one policeman personally. He is a great guy, I would trust my family's life to him if necessary.

Don't paint with too broad a brush. There are good and bad persons everywhere.

many individual police officers are good people.. the problem is that police departments such as davie police seem to be encouraging this behaviour and has a past history of doing so.. There was an incident recently where a police officer asked for sexual favors at the pd.. in the end the department actually covered for this officer and minimised his punishment to include no jail time.. if any citizens tried this what would have happened to them? there is no question that this PD is corrupt.. I remind you many of my family members are in law enforcement. and they all agree on this.

I believe when a certain police entity or any entity for that matter such as a mafia, or gang has on numerous occasions received complaints about similar circumstances occurring with that very same entity then I believe on a whole that entity is corrupt with criminals and it must be stopped before it escalates. Davie police has received endless complaints from residents of excessive force being used by the officers. I know a lawyer that lives in Ft. Lauderdale and he is aware of countless officers abusing citizens and entering homes uninvited. So it seems as if its not just a couple of people that are breaking the law but the department as a whole that is corrupt and it needs to be investigated by a higher force such as Internal Affairs or the FBI. They need to get rid of these criminals before they really hurt somebody or worse an innocent person gets killed.

Get a good attorney.. Sue the Police Department and list the cop as well so that you can sue him invidividually for violating your civil rights. That way you can take him for everything he has or will ever have. Cops don't make enough money to be able to withstand a good lawsuit so the guy will have nothing left in very short order. From there he will be on the street with nothing and might get what he deserves.

I'm sorry but I just do not believe your story.
You say that your father dinged some one car door, then the investigating officer showed up to your fathers home, forced his way in and assaulted him then arrested him for felony assault. To say the least this is a incredible tale, and incredible tales require incredible evidence.
but you don't offer any evidence, you give a very quick nebulous account of what happened then post a long letter that starts off on the IV amendment and ends about WW 2 and Binladin.

If this was about nothing more then a ding to the door when the police showed up to your fathers home why would they have to force their way in? Especially if your father has been a has no criminal record. Why would the cop then have to physically take down your father to arrest him? and then charge him with felony assault (I'm guessing he is being charged for assaulting the officer)?
you see I don't believe you not because I'm all pro cop or something like that, I just don't see the cop wanting to do all the paper work (and there will be reams of paper spent on this), going through a long investigation were he will be grilled by I.A., and spending a day or two going to court all of this just because he felt like being a jerk and beating on your dad.
As I said you need to give us far more then what you have.

I understand you being weary because we rely on the police to protect us.. it would be scary too think people are out there with a badge that would do all of this..I will post the police reports to show you the crime was a dinged door.. and my father was not the person they were investigating for the dinged the door incident it was a family member... my father WAS not a suspect

in the process of hiring an attorney to defend criminal charges, and for a lawsuit.. I am also going to the FBI for the pd violating civil rights.. One interesting note is that the people who charged the family member for the door incident are known drug dealers... and are currently undergoing a criminal investigation for rape... They are still out and have not been arrested for the rape... however for a door 2 people ended up in jail that night.. talk about justice right?

No I just watch a lot of TV. and using buzz words makes me feel smart. They have a whole system set up to keep people like me out of the force. First domestic assault where3 some dude beat on his wife and kids I'd empty my 9 mil in him.

The violent act was picking up the phone to call the police department about the officer... 2 minutes and 50 seconds was recorded by the pd of the call and we are in the process of getting that as evidence.. oh and I don't watch television...

Well, we are in these times where anyone with a semblance of power will grab onto it and do what maybe they otherwise wouldnt do.
They've (police) been awarded the big bad black ops suits, they are working alongside HOMELAND INSECURITY, they feel a power high.

Now, of course, most of them are NOT this way, but unfortunatly, some are, and are very willing to do harm and rough people up because they are in a "war" mode, sortof like, i'm going to beat you up in case you do something wrong.

Most see themselves as the new glamour boys, and with that comes whatever suits their moods. I dont think they feel they have to answer to anyone anymore, after all, werent we in other countries abusing people???? Its pretty much phycological mind sets they are in now.

Personally, i wouldnt ask one for directions anymore. what for.

Finally, i have to tell you and remind others this is the new America, regardless of Obama, and unless Obama puts everyone in their right places, the drums will keep beating and the power will increase until we are at the point of not being able to leave our homes for fear of...anything.

I agree with almost everything you just said but this is all bigger then Obama. Obama unfortunately is just a puppet and will more then likely assist to drive this country into greater turmoil. Our government has been infiltrated on multiple levels and JFK was the last president to try and put an end to this "secret entity" that was controlling the major branches of the US government. At first JFK wanted to give the powers of the money supply back to its rightful owner the US treasury and he also started gathering silver as the backing of this money supply. He was assassinated before he could ever announce this change but he did pass an executive order 11110 that would abolish the Federal Reserve but they never left...Go figure. Everything is only going to get worse before it looks like its going to get better. This incident with the police is something that people have to be aware of and we need to take a stand against scum like this because if we dont they will be escorting us out of our homes with an automatic rifle pointed to our backs. Everyone needs to start opening up their eyes before its too late. If you have not heard the last speech before JFK was assassinated I have provided the link so you can hear it.

the issue may not actually be the police i mena he could have been acting on orders. i think that if a police officer forced his way into your home without a warrant it violates the us constitution though it might have been a supierier officer that ordered him to arrest your father without a warrant though punching your dad in the face? that is wrong the police are supposed to protect us, if they dont who will if we cant trust our officials who cant we trust?
