You can show a Birth Certificate that says you were born in Timbuktu and still get a U.S. Passport (and/or a D.L., Social Security Card, etc...), as long as you are a U.S. Citizen. The question isn't whether he is a U.S. Citizen, the question is whether he was 'BORN ON U.S. SOIL'. The argument is based on the document provided. You can get a 'Certificate of Live Birth', no matter where, when, or how you were born. You can be five years old, from the country of China, and adopted by Americans and get a court provided 'Certificate of Live Birth' naming your adopted parents as birth mother and birth father. A 'Birth Certificate' has the signature of the delivery hospital, agency, or clinician as witness. Knock, knock...anybody there?

"There have been numerous requests for Sen. Barack Hussein Obama’s official birth certificate. State law (Hawai‘i Revised Statutes §338-18) prohibits the release of a certified birth certificate to persons who do not have a tangible interest in the vital record," DOH Director Dr. Chiyome Fukino said.

Fukino said she and the registrar of vital statistics, Alvin Onaka, have personally verified that the health department holds Obama's original birth certificate.

"Therefore, I as Director of Health for the State of Hawai‘i, along with the Registrar of Vital Statistics who has statutory authority to oversee and maintain these type of vital records, have personally seen and verified that the Hawai‘i State Department of Health has Sen. Obama’s original birth certificate on record in accordance with state policies and procedures," Fukino said.
