The complaint is asking for declaratory relief (asking the court to declare Obama is not a US citizen, a “natural born” citizen and not eligible under the qualifications of the US Constitution to run for Office of President).
Also asking for injunctive relief and an emergency TRO. Further asking for EXPEDITED Discovery.
We are asking that Obama provide a “ceritified copy” of the oath he took to regain his citizenship. We are asking for court orders, ordering the state department, HI department of records and other governmental agencies to turn over any and everything on Obama, all certified.

In his Sept. 29 filing, Berg said: "Plaintiff served discovery in way of Admissions and Request for Production of Documents, on Defendants on September 15, 2008 and has attempted to obtain verification of Obama's eligibility through subpoenas to the government entities and the hospital's in Hawaii. To date, Plaintiffs and two of (2) the locations, which subpoenas were served upon, refused to honor the subpoenas.
In this filing, Berg argued that he has legal standing to bring suit against Obama—and the DNC—pursuant to 5 USC §702; 524 US 11 (1998); 8 USC §148(b); 5 USC §552(B); 28 USC §1343 and also standing pursuant to Federal Question Jurisdiction. Berg rightfully claimed he has suffered "...the kind of injury that Congress expected might be addressed under the statute..." since the issue of where Obama was born with conflicting birth certificates and conflicting claims of what hospital Obama was born in—with Obama's own family members claiming he was born at three different hospitals in two countries.
"Defendant Obama claims he was born in Honolulu, Hawaii on August 4, 1961 and it is uncertain in which hospital he claims to have been born. Obama's grandmother on his father's side, his half-brother and half-sister all claim Obama was born not in Hawaii but in Kenya. Reports reflect that Obama's mother traveled to Kenya during her pregnancy; however, she was prevented from boarding a flight from Kenya to Hawaii. At her late stage of pregnancy (which apparently are normal restrictions, to avoid births during flights). By these reports, Stanley Ann Dunham Obama gave birth to Obama in Kenya, after which she flew home and registered Obama's birth. There are records of a "registry of birth" for Obama, on or about August 8, 1961 in the public records office in Hawaii."
The Times Herald even reports: "the senator's grandmother, brother and sister, who live in Kenya, believe they were present during Obama's birth in the African country." Here, the Times Herald uses the word that his family 'believe' he was born in Kenya (perhaps to avoid possible law suits by Obama's Truth Squad?).
On Thursday, Philip Berg filed a temporary restraining order in federal court to bar Obama from running for president, claiming the Democratic candidate was actually born in Africa. "We really don't believe he was born in Hawaii," Berg said. "We think he was born in Kenya." The presidential candidate's father, Barack Obama Sr., was born and raised in a small village in Kenya, according to Obama's campaign Web site. Berg's suit claims the senator's grandmother, brother and sister, who live in Kenya, believe they were present during Obama's birth in the African country.

I don't like Obama either, but it doesn't matter where he was born. His mother was an American citizen, doesn't that make him an American citizen, technically? There are many other reasons to dislike the man, but I don't believe it will matter where is actual birth took place.
