It doesn't matter. The Colorado Supreme Court determined that he did. SCOTUS isn't charged with overturning that finding. They're charged with determining whether or not a state can make the determination to disqualify a national candidate.
It's about states' rights, not whether or Trump did it,

There was all the due process required under Colorado law, which is all you can ask from Colorado courts. There was a civil trial held and the court decided on the basis of the evidence presented that the preponderance of evidence favored the conclusion that Trump engaged in insurrection. The Colorado Supreme Court upheld that finding.
