It would certainly be possible evidence, but once again it all comes down to intent. Based on what we know so far, it sounds like he was fleeing the scene of another crime, came upon the parade, and then either lost control of the car or intentionally drove through the crowd.

If intentional, then it needs to be determined what his motive was.

It's with noting that it was almost 6 PM when the tragedy occurred while sunset was around 4:30. It would be very hard for Brooks to determine the race of anyone under those lighting conditions before plowing into them.

The police chase narrative was always bull. They were speaking about a police chase prior to even having a suspect.
