I don't know about how NY employment laws work, but in most states the only way unemployment can be denied is if the employer contests the claim. The state has no right to deny a claim otherwise.

So, is NY relying on all these employers to contest the claims, or are is the state somehow acting unilaterally?

I would say if the state is acting unilaterally then this action would be fertile grounds for a legal challenge against the state.

If the employers play along, that might be a harder case to try.

Sadly, the state has been acting unilaterally for about 18 months straight now.

(Great responses on here--thanks to everyone who has added to the discussion!)

I always hear how tough New Yorkers are however they vote for Bloomberg, DeBlasio and have the most absurd laws. How can they vote for Schumer, AOC, Nadler etc
NYC is a cesspool of socialist goons all voted and supported by New Yorkers. Now they are surprised by the Nazi style tactics used during covid-19.
Cry me a river, they should change the way they vote and get those lunatics out of office, school boards and social networks.

This is a pandemic related issue.

I remember many people here railing against PUA. Now that the shoe is dropping near to where it affects you are up in arms because certain group of people will not receive unemployment.

The NY government is wrong here as many of you were back a few weeks back when many were celebrating the ending of PUA.

This is yet another example of “careful what you wish for”.

That’s technically being fired for cause so why would anyone expect to receive unemployment pay ? No state in the union pays unemployment to those who are fired for a specific cause. They made a rule, whether I agree with it or not they are allowed to make rules for their employees. These rules often include dress codes and other intrusive steps into the private lives of workers.

There are ways to make money, way more than the usual unemployment checks the state issues. No evictions, doubtful they will cut water or power in winter. Don’t understand the surprise at this as it’s normal

Are you sure you're replying to me? I can see you've hit reply to me and are using the pronoun "you," but won't ever find a word from me railing against PUA. Go ahead and look, I'll wait.

Ah ketsuko, think about what you just put. Nationalise it, socialize it????? You do realise how your health system works? It's full of greed, from the doctors to the insurance companies and THEY DEFINITELY WILL NOT RELIQUISH THAT GOLDEN EGG.
If you really want to look at a nationalised, socialist system look at the NHS in the UK. The system here, in the UK, used to be the very best in the world till these people in power now started to secretly defund it, secretly start to privatise sections and are going hell for leather trying to get the American system here. God help us when (that's when not if) that happens.
Oh, and by the way our health system is nationalised and socialised and we ARE NOT A COMMUNIST COUNTRY.

Move this to The Mudpit and you'll get real answers.

In the meantime, it may be legal since they might be getting "fired" for just cause (in their minds)🧞‍♀️

Lots of effort (by authorities) put into creating as much chaos as possible☠️

If you can't get unemployment, you can't get the extended unemployment either. The two are linked.

Uh ... huh ... wake up. Your system works the same way. It's driven by money, and if your system doesn't have the money, you don't have the care. The only difference is that your money doesn't come directly out of your pocket. Your government simply takes it first and hides how it's spent and on what so that you are never aware of all that could be available and how quickly.

But I suppose it's true what they say: Ignorance is bliss.

People should be able to express themselves without having to attack one another. I'm here for an exchange of ideas, debate, not a mud bath

I definitely agree to your comment regarding a deliberate chaos sown.

Your job, your ability to make money is your families life's blood. It seems that is what they want to attack, what if the next big thing is chips. If you do not get the chip you will be fired, no one can hire you, you lose all insurance, we freeze your accounts and credit....

Do you get the chip?

I know that this has been watched 1000 times, but I would watch 1000 times and I would watch 1000 more just to be the man who watched 1000 times to...sorry, a song popped into my head there for a second. Still, I thought to post it again because it's perfectly apropos to what you said above...

According to Reuters,

-New York Governor Kathy Hochul is considering employing the National Guard and out-of-state medical workers to fill hospital staffing shortages with tens of thousands of workers possibly losing their jobs for not meeting a Monday deadline for mandated COVID-19 vaccination.

TENS OF THOUSANDS - yikes. "V" used to stand for Victory. I guess it now stands for 'Vaccine'. So tomorrow is "V" day in New York. Good luck everyone.

There's no way this will make the healthcare situation better. Just how bad of a hit it will take remains to be seen

Just wait ... once the government breaks it, then they'll have to nationalize it, socialize it in order to "save" it because clearly, capitalism will have failed.

100% correct.

All you can really do at this point is consider that all government employees in management positions and all politicians are bought and paid for, and are therefore enemies of the people. None of their pontifications make any sense, unless you consider that they are in facts treasonous and paid off criminals.

Cheers - Dave

So let's see ... if she pulls 10s of thousands of National Guard to prop up the health care system, they all have to come out of their own private lives leaving holes in other walks of life.

And how many of them are likewise not vaccinated?

Does she even have "10s of thousands" of vaccinated National Guard members she can just safely yank away from the rest of her economy?
