I just saw where lover-boy had done eight years for a felony coc aine rap. You'd think he'd want to steer clear of any conflicts with the law. He might get the 15 years after all.

I'm all for Life, Liberty and the Pursuit of Happiness. But their liberty doesn't trump anyone else's. People were bothered by what they were doing, there's a law against lewdness, they broke it, a complaint was filed, arrests were made, they got their day in court, they were found guilty by a jury of their peers. Looks like Due Process to me.

He could've resisted arrest and we might be talking about this in the Possee Comitatus forum. I'm glad no one had to die over a piece of @$$.

From what I've read he will get the full 15.

Maybe since he didn't really commit a felony he didn't think he'd get arrested for one.

Could be that the reason they didn't take the offer was because they know they weren't having sex and didn't want to admit to something they didn't do.

Could be that they were relying on the truth and the fact that nobody could prove they had sex which should be enough.

But who cares about Innocent until 'Proven' guilty now anyway, right. As long as someone thinks you did it, you did it. F*ck the truth.

Could be you're absolutely right. Unfortunately, you only have to be 'found' guilty in court.

I had a judge explain that to me when I was a very young man. It was easier to plead guilty and pay a five dollar fine. My first personal lesson in avoiding conflict with the law.

Fifteen years is excessive but hey gotta feed the prison industrial complex. Granny wants to hold onto the innocence of what my (ex) state used to be. While, who didn't engage in these activities on the beach, but at least kept it out of the view of children. These people are likely not local, not understanding that it's Florida not desolate free for all beach.

In Mississippi it's illegal to curse in front of two or more people in public. Can land you in jail. You ever done that? Oh the humanity, what about the children.

It's illegal to play bingo in North Carolina for over five consecutive hours. I can't imagine all the senior citizens across the country who dare to break such a standard.

All sex outside of marriage is illegal in Virginia. Hope you never engaged in such an act, or any of your acquaintances in life prior to tying the knot. That would only be a "mistake" because anyone doing it was stupid enough to engage in such an act. Hey, I learned that line of thinking from you. Cool.

And as for Florida, it's actually illegal for unmarried couples to live together. Oral sex is also illegal, for everyone.

Wow, all these people committing acts legislators have deemed offensive. What's wrong with these people. Or maybe, just maybe, people should stop having such asinine reactions to acts which don't harm others. Grow some thicker skin.

Its one thing to be doing something indecent like this, but its quite another thing to have a legal system that is far more evil and criminal in even considering 15 years and revolting to be surrounded by citizens who agree with kidnapping and torturous long term imprisonment for anything short of repeat sociopathic murder and rapes OR serious corruption of officials.

How about 1000 dollar fine and payments with a month of community service weekends? And kids do know about the birds and the bees and I wouldn't want them raised in such a punitive police state. I'd be breaking them out of jail if someone tried to target them with their criminal legal system. I don't understand why people take this and don't rescue people in large enough numbers that their employees sit down and shut up.

Real sex or simulated sex; both would be considered lewd activity in a public place. That is why I have no issue with the case. They could have accepted a plea deal, because they knew very well they''d at least pretended to have sex. It isn't like they thought the motions they were making could have been construed as anything else. Shooting a porn in a public place wouldn't be allowed, and what they did isn't so different. Here, the recording was for evidence, but their behavior was still improper for a public location. I believe simulating sex in the beach should be criminal, as much as actually having it. Plus, why would they do that??? That would be asking for people to complain. Real sex makes more sense. So, in my case, at least, the truth is that they were very wrong in either case. Make sense? There is proof that they at least simulated sex.

If you have issues with the laws, petition to change them. The couple did break the law, and they refused a plea deal. Having sex out in front of others is not only lewd, but asinine, thoughtless, and irresponsible. Who are you to decide it isn't harmful to others? They should have gotten a room. Florida beaches; there will be cheap hotels around. Maybe, just maybe, people with no moral values shouldn't expect the rest of the world to think that whatever they do is alright. Let them grow a couple of brains.

I don`t see any problem with that, sex is not a life saving function, if they can`t control themselves long enough to get back to their home or hotel room then let them sit in prison for 15 years.

They should have just killed someone instead,they would have only gotten 7 years.Wow. I would say it doesn't belong in front of kids,no way. But do you arrest a parent if their kid walks in on them in their bedroom? Kid can still see what is what. I think its more how you treat it with kids than anything. We have hang ups here in the US about sex anyway. Just my take on it.

this reminds me of a joke, i can't tell here, well maybe if i edit it some.

there was a couple in floridia that were arrested for having sex on the beach.
the day they went to court there were three witnesses.
the first witness who took the stand was a young surfer.
the DA asked him what did he see.
the young man said they were, (expletive deleted).
the judge slammed his gavel down, and dismissed the witness.
the next witness was a young lady who had been sun bathing.
the DA asked her what she saw, she said they were (expletive deleted).
the judge again slammed his gavel and dismissed her.
by this time there was a lot of laughing and giggling in the court room.
the judge said that he would no longer tolerate such language,
and that the next one who used such would be held in contempt,
and face a fine of 100 dollars or 10days in jail
the last witness was a homeless man.
the DA asked him what he saw,
he sat there a few seconds and said,
well what i saw was ten toes up, ten toes down, two a@@es moving round,
then he turned to the judge and said,

but really if you can't control your self until you get home, get arrested and are offered a plea deal, take it. other wise you deserve everything you get.

It showed them gyrating with her on top. Nobody could say they saw penetration or genitalia at all. They thought they were having sex and presumed they were, but can't prove they were at all.

I'm getting the feeling that some people couldn't handle the age difference between the two. The OP states the man was 40 and the woman half that.... Perhaps there were some jealous folks on the beach and in the courtroom and that may be the real reason behind it all.
Just a thought I had, not saying it is valid but the possibility is there.
