The British Legal System is a lot of things; Sometimes the law is an ass, capable of grave injustice but the system gets it right more times then it gets things wrong. It is also part,imho, of our shared British identity.

But if some British people of Jewish and Islamic faith want to solve some civil cases via arbitration, then Im not sure why as a Country we shouldnt allow them that option. As long as the process is fair and the decision's comply with UK law, obviously.

Im aware of the one for all campaign and, this may suprise you, agree with most of their ideas, if not all of their methods.

- The power to grant a normal Muslim religious divorce (not a secular divorce) under Sharia law
- The power to grant a forced marriage religious divorce under Sharia law which can be used as evidence in a normal court when pursing a secular divorce.
- The power to make Commercial and Debt Disputes under Sharia law, enforceable in a secular court.

The real teeth is the powers it has to make judgments under Sharia law on commercial and debt matter which are enforceable in a secular court (in the sense of exercising the remedy granted). Firstly they are a constituted tribunual as defined under the '96 Act and not a court, I know that you may feel I'm being slightly pedantic but it is an important distinction in law. There must be a trained lawyer on the panel and an expert, which in the case of the MAT would be an Islamic scholar.
The tribunual and its proceedings are at all times, under the juristiction of UK law, which also retains the right to intervene where the award is unfair or not in the public good.

A MAT decision (under the '96 Act) taken to court for enforcement would be looked at imo, but please provide case law which shows otherwise.

Why would you seek to exclude one group of people from the Arbitration process?
Actually under the Arbitration Act 1996, a Scotsman in London could do just that; All he would need is an Scottish arbitor and the permission of the other party. Arbitration is basically two or more parties coming together to make a deal outside of a magistrate's court.

While the Tribunal is under the Jurisdiction of UK law, decisions are made under Sharia law.

To quote the Tribunal's web site again:-

A Judge or officer of the Court may not act upon an unlawful order. While the Tribunual may be properly constituted under the Arbitration Act 1996, the award may not be.
It is however encumbant upon the parties agreeing to Arbitration to fully understand and make a reasonable effort to understand, the implications of an arbitration agreement.

I was. Both Tribunals make decisions that cannot be enforced directly but have to be registered with the High Court (MAT) or the High court and a County court (Employment Tribunal).

No one would suggest that the Employment Tribunal has no legal power. It may not have the power to enforce its judgements but it sure has power to make them.

I thought you had already accepted that the MAT and other religious arbitration panels can take into account social and religious views when making a decision, but that decision must be compatible and within UK law.


Unless of course you think that more recent legislation has changed significantly the legal status of an arbitration tribunal and its decisions.

The civil judgements by the Muslim Arbitration Tribunal may not contravene English criminal law but its civil rulings are clearly not compatible and within UK civil law.

It applies Sharia law on Commercial and Debt matters.

As you are aware, on Commercial and Debt matters, the Muslim Arbitration Tribunals applies Muslim Sharia law and not UK law.

The scope for the HIgh court to intervene, when enforcing the Muslim Arbitration Tribunals' judgements, is limited to refusing to enforce remedies that are illegal or contrary to public policy/interest .

In the UK, Sharia law is applied by the Muslim Arbitration Tribunals on Commercial and Debt matters and the High Court enforces it.
