It would be interesting to follow up with this girl in 10 years if nothing comes of this to see what porno movies she stars in or what street corner she works on

This is quite a stretch, don't you think? And I find it quite sad you would even say this.

So, I guess with your theory, anyone who smokes a little weed as a teen/young adult, will end up being a drug king pin or selling dope out of the back of their car to innocent kids?

What she did is absolutely in no way a sign of what she will be in 10years. Any reasonable logical thinking adult would know this.

Im sure this has all shaken her up a bit and I bet, she becomes quite the opposite of what you think she will.

If you don't know what being on a sex offenders list entails, than why are you debating something in which you have no clue about? Go do some research then maybe I will take your opinion seriously. BTW, if she wants to be in the porno industry when she grows up, thats HER choice, not the goverments, or yours. This is a very stupid argument.

Yea there's a fine line between sexually explicit photographs taken for the expressed purpose of arousing another. And those photographs taken by your parents in order to humiliate you during your teenage years.

exactly, it's a fine line - and very subjective. There are endless debates to define pornography. Legally, pornography is determined by the viewer, context and original intent. For example, and picture that was taken without sexual intent, could be posted to the internet in a different context, which would make it porno.

(a) whether "the average person, applying contemporary community standards" would find that the work, taken as a whole, appeals to the prurient interest, Kois v. Wisconsin, supra, at 230, quoting Roth v. United States, supra, at 489;
(b) whether the work depicts or describes, in a patently offensive way, sexual conduct specifically defined by the applicable state law; and
(c) whether the work, taken as a whole, lacks serious literary, artistic, political, or scientific value."

every single one of those stipulations are completely subjective - as "offensive" is subjective.

Family photos taken by father at Water World, confiscated by the FBI, including photos of his twelve year old daughter in a bikini.

The father claims he was "just taking family photos for memorabilia and had no intention of any lewd conduct".

Chief Inspector WhatuKno is leading the investigation. "We found the photos on the hard drive of a pedophile, who downloaded them from the families personal web site".

The father may serve life in prison for incest and various child pornography charges.

So this fifteen year old in the US can not legally pick a sexual partner above the age of eighteen, but the law can find her guilty of having a grasp of consequences enough to try and lock her up for ten years for taking nude pictures of herself and sending them to friends? This girl can’t be an innocent minor who isn’t allowed her choice of a partner sexually and be charged for sex crimes against other minors, finding her competent of the sexualized crimes she committed. Is this girl a child with a child’s mentality or is she not? Our system needs to make up its damn mind.

I completely agree. But they won't lock her up for ten years, she'll be registered as a sex offender for ten yrs, and charged with a felony, and maybe some time. On every application she ever goes to fill out for the rest of her life, she will have to put down she is a convicted felon. Also, for ten years she will be labeled as a sex offender, which has many stipulations.

I wouldn't worry too much about her though, even a dumb lawyer should be able to get her off the hook.

Why is this sort of behavior on this board being condoned? What good can possibly come from allowing this child to pose nude for sexually explicit photographs?

It's been my long standing opinion that women that pose for such things won't tend to say no to much else. I don't think that this is a case where it should be condoned or allowed to go unpunished.

Perhaps no she doesn't deserve to be put on the sex offender list. But perhaps some sort of punishment for her obviously deviant behavior should be shown. I mean seriously do you all actually feel this is acceptable behavior?

Obviously her guardians aren't doing their jobs as caregivers perhaps a little scared straight slap on the wrist by a judge is exactly what this young lady needs before she decides that her carrier choices include prostitution or hard core porn.

Stop right there.

Before you go on and on about how this board is thinking. Read our damn posts man.

Who said we agree with her behavior? Go back and read our posts. You will see we do not. We are suggesting consequence. She needs to have her cell phone taken away for a bit and someone needs to educate her about pedophiles that can easily get their hands on photos that are sent electronically. And maybe her caretakers should tell her about the birds and the bees?

What we don't agree with is the criminal punishment that you do!

A few years certainly can change a lot. If this girl was eighteen she could be paid for what she did. However, I certainly think that punishment outside the realm of "privately" should be enforced.

I must be a real traditionalist but what the hell? We aren't animals, folks. Our kids are having kids. The real problem here is the fact that our young are not educated about sex. Nowadays, they learn that sex is used as a bargaining chip, a relationship starter and something done for money. Kids learn more from porn than their parents! But its not like it was in the 60's and 70's... Sex can kill you now.

I went to school with girls like this. A few of them found sanity and eventually turned into upright citizens. MOST of them had kids at 17, or are drug addicts and prostitutes, or are just genuinely miserable people. This girl needs to see this is no small problem.

My parents did not dilute me, they taught me and my sisters about sex at a young age, so it was never this "grandiose" view on it. Therefore we didn't need to experiment in highschool, it was what it was. I focused more on being a decent human being, and made sex a secondary goal.

The real sick thing is that this girl probably lost her virginity a couple years ago.

Its people like this who eventually either become sexual deviants themselves or unwed drug-addict mothers. If the parents aren't there to stop this little skank, then apparently the law has to be.

Don't think this girl is such a "kid." She knew what she was doing, and at that age, she knew it was inappropriate.

I think everyone on this board is pretty much in agreeance that this is not acceptable behavior, and that she should be punished. But not this harshly. Read our posts, then maybe you will get what we have been trying to tell you.

She shouldn't have to face any penalties as far as i'm concerned...
How is this any worse than an actual 15 year old having sex with other 15 year olds? It happens every day and has practically become normal...
Alot of people lose their virginity by the age of 16.

Do they get punished for having sex? No...So why punish her for sending her friends nude photos.

Get over it

And I find it sick how far some people let their minds wander into the realm of assumption.

I agree. The bottom line, is her intent. Her intent was not to make child pornography, and she is being punished like it was.

I predict that she will see no legal reprecussions from this incident.

Well since she is in foster care I think someone should investigate whether this girl has been molested. Kids that are molested sometime start believing that their main worth lies in their sexuality, and that by acting in an overtly sexual manner they will be liked.

This situation just seems a bit too creepy. I think this kid maybe a bit messed up.

This behavior when busted by an adult should have resulted in a learning moment, grounding, loss of the cell phone, conversations. But it should never have become a public matter in any way, unless one of the other parents complained. But depending on the stink the other parents may have caused, any police activity should have been information about online safety and sexual predators. This is not an issue you drag out in the open because it is too embarrassing for any child to exposed in. And yes, it will affect how she feels about herself, her self esteem, the possibility of tuning out the trauma with drugs, or running away and having her life destroyed by the street slave market of prostitution, or the chance that she will end up in abusive relationships. Nothing that ruptures a relationship with a parent or the child's self esteem should be followed in any way. The law needs to be reworded as it pertains to an adult exploiting a child, not a child's behavior of being an exhibitionist with her friends and aquaintances.

I agree entirely with this post.. The whole "child pornography" label being placed on this case is absurd, but something needs to be done..

If you take her phone away, she shouldn't be allowed to have another one til she's 18. Somehow I found a way to live until that age without one.

I would like to see what some of you would say if this girl was 11 years old. Because its happening. My mother works for WIC and you'd be amazed at how liberal young kids are getting sexually. If she's in foster care, maybe they need to find her a new set of caretakers.

I have read your posts, what is disturbing is the amount of "well this behavior has gone on for a long time, it's ok cause she only is sending these photographs to her friends"

Who said we agree with her behavior? Go back and read our posts. You will see we do not. We are suggesting consequence. The punishments that everyone is condoning isn't any sort of real correction. It's a slap on the wrist. Take her phone away? She will just go to metro PCS after ditching school to get a new phone. Warn her about pedophiles? Apparently according to her actions she doesn't care about or is too worried about pedophiles. Birds and the Bees? Seriously? Shes sending explicit photos to her friends and you think she needs more education?

Yes perhaps being labeled a sex offender is too harsh. But what your proposing will do nothing to curb the issue either.

What we don't agree with is the criminal punishment that you do!

And I simply cannot agree with just a slap on the wrist for obviously dangerous and illegal behavior.

This young lady has committed a crime, while there is no victim here (although obviously her self esteem is suspect) It is a crime, she has produced something that is illegal to possess, what happens when she breaks up with her bf? What will he do? Maybe he will post the pics of her naked online for all to see.

Now obviously he had permission to have the pictures, I guess it would be alright for him to post them online for anyone to see right? No victim here.

So?

The 4 year old knows at that age it's inappropriate to steal from the cookie jar. That child isn't a deviant, and the kid isn't necessarily going to grow up reenacting scenes from Grand Theft Auto.

Yes this 15 yr old teen knew what she was doing. Of course she did. And she is old enough to know adults would smack her with a ruler if they found out. So? I seriously doubt she was doing it because she was the filthy whore you and whatukno want her to be. She wasn't making child porn either.

Every single one of us went to school with a girl that did stuff like this.

Hey, I confess I even slept with a 15 year old girl!!! Send the cops. Cuff em boys. I was a minor when I slept with her. So should I be busted on two accounts?

Taking her phone away from her untill she was 18 wouldn't be such a bad idea. Maybe she does need new caretakers, because she is obviously laking guidance. But thats no reason to jump to the conclusion that shes a whore. I mean, maybe she is who knows, but its not my place to say that, and quite frankly it wouldn't make a big difference in wether or not the legal action being taken would be appropriate in this case.
