HERE are some excerpts from Hur's 388 page SC report:


Appendix A (22 pages): Documents found in Biden’s office or home:



a top secret document “discussing issues related to Russian aggression toward Ukraine” that was attached to a memo from 2014,

a 2009 document from the Office of the Director of National Intelligence detailing topics related to the war in Afghanistan,

numerous biographies of unidentified members of “a foreign delegation”

Power Point slides detailing options for “the distribution and composition of U.S. forces in Afghanistan after 2014.”



Appendix B (5 pages): Handwritten materials/notebook entries which included classified information:



"a 2011 note about a Situation Room meeting with then-President Barack Obama on Afghanistan and Pakistan"


"a 2014 note about unmanned aerial systems"

"a 2015 meeting with John Kerry on a “foreign adversary”

"a 2016 entry on counterterrorism discussions."


Descriptions of conversations Joe held with his ghostwriter in which he ADMITTED to KNOWING he was in possession of classified information:



“Mr. Biden wrote down obviously sensitive information discussed during intelligence briefings with President Obama and meetings in the White House Situation Room about matters of national security and military and foreign policy,”the report says. “And while reading his notebook entries aloud during meetings with his ghostwriter, Mr. Biden sometimes skipped over presumptively classified material and warned his ghostwriter the entries might be classified, but at least three times Mr. Biden read from classified entries aloud to his ghostwriter nearly verbatim.”


“The practices of retaining classified material in unsecured locations and reading classified material to one’s ghostwriter present serious risks to national security, given the vulnerability of extraordinarily sensitive information to loss or compromise to America’s adversaries,” the report says."

Of course, Joe says he had no knowledge of any of this stuff being classified (even though he was recorded by his ghostwriter telling him it was classified...before joe ended up sharing it with him on tape).

Ultimately, Joe just blamed everything on his incompetent staff.

Looking forward to Special Counsel Robert Hur testifying before Congress to answer why he didn't think Joe Biden should be prosecuted, when he's no longer President.

Since the documents are the proof of crimes, Joe's testimony is not necessary. Hur must not have much experience prosecuting cases. (Came from the private sector.)

Here are the elements of a crime under the Espionage Act of 2017:

"(d) whoever, lawfully or unlawfully having possession of, access to, control over, ... any document, writing, .....or note relating to the national defence, wilfully communicates or transmits or attempts to communicate or transmit the same and fails to deliver it on demand to the officer or employee of the United States entitled to receive it....shall be punished by a fine of not more than $10,000, or by imprisonment for not more than two years, or both."

In summary:

1) Had possession or control over any document, writing, or note relating to the national defense? Yup, he did that.
2) Willfully communicated the same? Maybe yes, maybe no. He communicated some, but Hur wasn't sure he could prove the willful part to a jury.
3) Failed to deliver them on demand to an officer or employee of the United States entitled to receive them? Nope, he gave the ones he knew about to NARA and let the FBI come and get the others. You must be thinking of Donald Trump.

How many cases have you prosecuted?
