Again, examine the FACTS:

1. The letter, dated 11 August 2015, clearly states that some classified emails on Hillarys server were found to be classified at Top Secret//SI//TK//NOFORN.

2. TK means satellite imagery or information derived from that satellite imagery. This information is classified TS//SCI from the very instant that image is snapped.... before it is transmitted back to earth and long before it wound up on her server, it was classified.


4. 18 U.S. Code § 793 - Gathering, transmitting or losing defense information

(d)
Whoever, lawfully having possession of, access to, control over, or being entrusted with any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, or note relating to the national defense, or information relating to the national defense which information the possessor has reason to believe could be used to the injury of the United States or to the advantage of any foreign nation, willfully communicates, delivers, transmits or causes to be communicated, delivered, or transmitted or attempts to communicate, deliver, transmit or cause to be communicated, delivered or transmitted the same to any person not entitled to receive it, or willfully retains the same and fails to deliver it on demand to the officer or employee of the United States entitled to receive it

This is pretty clear….IF someone willfully transmits or causes to be communicated classified information to someone who does not have the proper clearance, ie; such as putting it on a thumb drive and giving it to your lawyer, then they can be charged under this provision.

(e)
Whoever having unauthorized possession of, access to, or control over any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, or note relating to the national defense, or information relating to the national defense which information the possessor has reason to believe could be used to the injury of the United States or to the advantage of any foreign nation, willfully communicates, delivers, transmits or causes to be communicated, delivered, or transmitted, or attempts to communicate, deliver, transmit or cause to be communicated, delivered, or transmitted the same to any person not entitled to receive it, or willfully retains the same and fails to deliver it to the officer or employee of the United States entitled to receive it

This is pretty clear as well, same as (d), key phrase being “unauthorized possession of”. IF someone has classified information outside of strict control, such as an unclassified email server in their home, they can be charged under this provision.

“Whoever, being entrusted with” This is a catch all phrase that applies to every single person who has or had a security clearance.

“(1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed,”

Gross negligence is exactly what it implies. No criminal intent is required for conviction. This negates any defense of “I didn’t know it was classified” or “I wasn’t aware it was classified”. Accidentally having classified material in any place outside of proper controls falls under this category.


“Shall be fined under this title or imprisoned not more than ten years, or both.” Pretty clear.

The one thing that is most important here that no one is addressing, is the possibility that there is nothing to blow the lid off of. Similar to Benghazi.

A few of the things people are claiming she is absolutely guilty of is not or was not against the law or any policy at the time she was using the private email and server.

Top secret servers including email servers are not connected to unclassified networks such as the regular Internet that we use. So they would have to copy them from a TS email, probably on a USB thumb drive, and then sneaker foot them to an appropriate computer to then send them to the intended recipient.

in my mind also, continuing from the Snowden leak, then the
"blessed" movie from the Whitehouse about bin Laden raid,
other similar made for TV segments on national security
featuring U.S. Generals, and military officials.

WTH!

I didn't claim to be a democrat I just would never vote Republican before. Its possible to not just blindly vote based off the color of the ticket. Hillary is a monster regardless of what banner she runs under, she's the living embodiment of everything that's wrong with the political class and corrupt politics.

And the FBI does in fact have a Hillary thumb drive with her server.
