Most of the interpretations I have seen say that 'natural born citizen of the United States' includes childern born ourside of the US to parent(s) who are American citizens (only one parent needs to be a citizen). Romney for instance was not born in the US and faced some of the same questions (though was never really an issue).

Cruz's mother was a citizen of the US when he was born - therefore, by most interpretations of the constitution he is 'natural born'

The problem is not that Ted was born in Canada, but that his parents were both citizens of Canada at the time of his birth. New documents are coming up that show that they were on the rolls and register to vote in Canada at that time frame, thus proving he is not a natural born citizen of the United States of America.

Apparently they were on the rolls to vote in Canada at the time of his birth. That would be a good indication that she gave up her citizenship to the USA, as the USA does not recognize dual citizenship, and was a legal citizen of Canada.

Just being born in the USA does not make you a natural born citizen. Two Germans cannot vacation to the USA and produce an American citizen, legally it does not work that way. Constitutional illiteracy makes many people think otherwise.

Obama was born to a mother who was a Natural Born Citizen, and a father who was a British subject. That at least makes him an Citizen of the United States and a British subject. According to some experts on the matter, that does not make him a Natural Born Citizen. But as I said, too late to debate that now. Hope and Change (tm) and all that.

However, children born to diplomats and other recognized government officials from foreign countries will not receive U.S. citizenship if born on American soil. You can learn more about this by looking through Title 8 of the U.S. Code.

If you were born in the U.S., your U.S. citizenship will last your entire life unless you make an affirmative action to give it up, like filing an oath.

I am aware that they are given de facto citizenship. What I am saying is that there is no legal requirement to do so.

14th Amendment states that the person in question must be "born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

In United States v. Wong Kim Ark the SCOTUS declared that if they parents were docmented as legal residents, their children would be American citizens. There has never been a ruling on the status of children born to illegal aliens or vacationing foreigners that are still subjects of the other nation's jurisdiction. As I said above, it is legal laziness that has led people to think anyone who pops out a baby on American soil has just produced an American kid. That's simply ignorant. We have too much ignorance in our country today.

Does anyone *seriously* think that the people who wrote the 14th Amendment, which was specifically intended to make the freed slaves into American citizens, the amendment that specifically did not confer citizenship to Native Americans who did not pay taxes and were not subject to any state's jurisdiction... do those people think that the writers were creating a blanket amnesty for any foreign fetus born lucky enough to break it's mom's water while she was paying a visit?

Want to be an American? Be born to at least one American citizen, or naturalized. Either way, documented by the government. That's it. Natural Born Citizen, that's a little more muddled.

Any kids born in America to 'undocumented' parents should be given a certificate from the hospital in question that states the time and date that the kid was born, then the parents can take that certificate to their consulate and get a birth certificate. That'd stop a lot of these damn DACA/DREAM headaches.

As anyone born in the USA is subject to USA laws, except diplomats and invading armies, children born here except the above are natural born US citizens....

The fact that both parents were registered to and probably did vote while citizens of Canada, makes him a Canadian citizen. They immigrated back to the United States, and thus he is not a natural born citizen. Both of his parents were citizens of Canada at the time of his birth. They were voting in Canada at that time frame as well. That shows that his mother, for a time gave up her citizenship by becoming a citizen of Canada, living, working and VOTING.

It will take a judge to determine and further define the nature of such.

It's about being subject to jurisdiction thereof and stuff. Two German citizens would be aghast to suddenly discover that their child is now American and owes first allegiance to this country just because they happened to be in the wrong place at the wrong time.

The only reason we ever set this aside is for the "convenience" of illegals.
