I don't think it can go that way.
Pretty sure the seat has to be vacant before the Senate interviews and votes.
(I could be wrong about that, but I'm pretty sure that's the standard procedure)

I can see it now .... Trump gets elected, Sotomayor is out while he is in office, and Trump gets ANOTHER SCOTUS pick. FOUR. I'm not a Trump fan but I'd laugh my butt off watching the left completely melt down and try to destroy democracy while pretending to preserve democracy.
