I could be wrong but doesn't the affidavit has to be done by an FBI agent if there are going to be Federal charges? One would assume she was there for DePape's questioning which no doubt there is a video recording. Regardless I can easily see the SFPD deferring to the FBI.

FWIW I could have phrased that better, the affidavit says he was restrained and the officer is the one who took stuff from his right shorts pocket.

again the affidavit is online there is no ambiguity the officer says he had shorts on.

But get this, I missed this earlier the San Francisco PD recovered zip ties in the hallway and in Pelosi's bedroom? That means DePape broke and made it all the way to Pelosi's bedroom. How close is the bedroom to the entrance where all this occurred? Because the eyewitness says he saw someone wearing black walking near the house then heard sounds like banging on a car or door and 1-2 minutes later heard sirens.

The affidavit mentions body cam footage one would assume it's gonna have microphones so virtually anything the police officers saw would be taped and videoed, including anything DePape or Pelosi, said.

The man accused of beating U.S. House Speaker Nancy Pelosi's husband with a hammer during a struggle in the couple's San Francisco home was expected to make his first court appearance on Tuesday.

David Wayne DePape, 42, was scheduled for a hearing where he will be advised of the state court charges against him: attempted murder, assault with a deadly weapon, burglary, elder abuse, and threatening a public official.

It was not clear if DePape would be in court for the arraignment or if he would appear via video link from jail or a local hospital, where he was transported after his arrest.

Federal prosecutors have charged him separately with assault and attempted kidnapping. He is not yet scheduled for a court appearance in the federal case.

The attack has stoked fears about politically motivated violence one week before midterm elections that will decide control of Congress.


DePape was arrested by San Francisco police after Paul Pelosi placed an emergency 911 call reporting an intruder, according to an FBI affidavit filed in the federal case.

Officers recovered zip ties in the bedroom and in the hallway near the front door as well as a roll of tape, rope, a second hammer, a pair of gloves, and a journal in DePape's backpack, the affidavit said. The intruder had broken in through a glass door to the residence.

Paul Pelosi told police he was asleep when a stranger armed with a hammer crept into his second-floor bedroom and awakened him, demanding to speak with his spouse, according to the criminal complaint.

Authorities said police officers arriving at the Pelosi home saw DePape and Pelosi struggling over a hammer. As the officers shouted at the two men to drop the hammer, DePape yanked it away and struck Pelosi in the head before being subdued and taken into custody.

The state charges are punishable by a prison sentence of 13 years to life. The federal charges carry a combined maximum sentence of 50 years, the Justice Department said in a statement announcing the charges.

FWIW all of that should be visible on the policemen's body cams, it is all explained much better in the affidavit. I mean it says Pelosi answered the door all of which was according to the affidavit done in front of the officers and likely on thier bodycams

I don't doubt you but I'm not familiar with the DUI case at all. I'm gonna have to research it more.

That said the affidavit is from the SFPD officer's viewpoint most of the points were said to these officers ie it's recorded.

The question remains will it be released? That could depend if there is ever a court case, and how vigorously his attorneys fight for his case. As the affidavit states some of this was spoken to them on the way to the hospital IIRC. They will have a hard time saying there aren't recordings of DePape's statements.

Again according to the affidavit, it sounds as if it didn't get violent till the officers came Pelosi opened the door, which puzzles me in itself. Have heard some suggest Pelosi buzzed them in and once the officers got closer DePape Pelosi began struggling with the hammer and DePape got in a few whacks before they could cover the distance and subdue him. Ive seen others suggest DePape didn't freak till the cops showed up. The way it sounds in the affidavit DePape once he found out Nancy wasn't there wanted to tie Pelosi up so he could go to sleep. This is when Pelosi said he need to go to the bathroom, so they weren't arguing at that point.

again the thing about Smollett it was set up completely, while this sounds more like a coverup. FWIW the Smollett thing failed miserably, I can't see SOTH using them again for anything. Besides those were Hariis' connections, and Nancy sounded a bit frosty in the article below from 2 years ago.
