Good theory. Doesn't seem to work in the real world.
Or did people not get pregnant unintentionally when abortion was a crime?

not exactly, the supreme court will still hear the case, and well, it will only divert back to the lower court decision if they return a tied vote, and even then they could allow it to be reheard again later once the empty seat is filled. then again, they could just do what they seem to be doing with the little sisters case, just ask the opposing parties to come up with suggestions for a suitable compromise, and well delay because they don't want to hand down a tied vote.
