Actually, it's an interesting one from a legal point of view, but I m no expert in murder.

Seems he'd have no defence of acting in self defence.

So, was the killing lawful as opposed to unlawful?

Usually such cases have involved Police or Soldiers.

But I suspect that the CPS would just decide not to prosecute

Just my initial thoughts.

People rip the USA for guns. But if you are 80 years old, would you rather live in a society with guns where you can carry one to protect yourself and possibly shoot someone who has their own gun trying to kill you. Or would you rather deal with knives and some drug addict twice your size and half your age trying to kill you?

That basic problem is why I would rather live in a society that's armed to the teeth instead of one where most people are helpless and have to rely on everyone else following the law for you to be kept safe.

Yeah, US homicide rate is about 5 per 100 k of population (about 16000 per annum); UK is about 1 per 100k of population (about 800 per annum).

I know where I'd rather live and would feel safer. And it wouldn't be the US...
