The real question that the FBI is going to answer: Did she use a private server in hopes of evading FOIA requests. That is the bottom line.

I don't know, but this is not the first time a private server was used to conduct official US business by someone in an administration.
In that other case, it was never prosecuted. Hell, it wasn't even fully investigated even though it was projected that potentially 22 million emails were missing.
It's going to be real tough, unless there are emails or testimony, to prove that intent.
