Woman who struck boys with SUV, killing one is suing families for emotional trauma

Sharlene Simon told police she was driving 90 km/h in an 80 km/h zone and didn’t see the boys.

In a statement of claim filed with the court last April, Simon is claiming $1.35 million in damages due to her psychological suffering, including depression, anxiety, irritability and post-traumatic stress.

She blames the boys for negligence.

“They did not apply their brakes properly,” the claim states. “They were incompetent bicyclists.”

None of the allegations in the suit have been proven in court.

Simon’s lawyer, Michael Ellis, said the money is necessary to help her with the damages she suffered, including the loss of income and therapy for her emotional trauma.

What. A. B. The boys toxicology reports came back completely clean, and she was driving home from the bar, with her husband (a cop) following her in his vehicle. She somehow managed to hit the boys. Somehow.

“This is not a counter suit – it has nothing to do with the insurance,” said Cameron.

Simon’s lawyer, Michael Ellis, admits Simon was not physically injured in the crash. The $1.35 million she is claiming includes her costs for loss of work and medical costs for therapy for her emotional trauma. “She would have lost everything,” Ellis said. “She would have been destitute … homeless.”

But Cameron said the Simons each had one million-dollar insurance coverage which would have been more than enough to cover any claims for the Majewskis or the other boy who was seriously hurt. Plus her insurance company would have additional coverage if she needed emotional counselling.

I just can't believe the callousness of some people. Making the surviving boys and their families and the deceased boys family go through this. I'm having a real hard time understanding how she can justify this in her own head. I'm having an even harder time understanding how her husband can.

As far as I can tell the families here weren't trying to sue her personally, just get the insurance company to pay out. Perhaps they will change their mind.

Justify? It is all about money.That is all the matters anymore to 'most' people. It is a shame,but living in a capitalist society does this to people. Who ever has the most wins at all costs to get there. Such a very sad commentary of where we are as a species now.

If they didn't pay with cash, or hell even with cash you can prove she was drinking and driving with a simple receipt. Friend of mines dad got busted that way when he was at home sleeping for two hours after. It's a long stretch, but it can happen, well here in Canada it can.

I can only say that this is proof that many psychopaths know how to play the social game so that they "look" respectable. I can also say that I have NEVER said something like this about another human being in my life but...

This quote is from a page on this FB purporting to be a 'Stand By Sharlene" page. I only hope that niether she nor her friends or family is actually behind this garbage. They seem to be taunting the families of the young men killed and injured.

There are no words I can use to describe the sickness that dwells within some people. And it appears that after reading as much as I could stomach which was not much that they will share in the insurance settlement with the family of the young man killed and the injured one.

I just cannot begin to understand the reasoning behind allowing an individual to leave the scene of an accident and no toxicology test performed on her as a driver admitting to exceeding the posted speed limit...just nauseating and honestly wish I never opened the thread.

That this is even being entertained by a court speaks volumes about the "justice" system. Should should be behind bars for even bringing the notion to the court.
