It's an aspect of the case that will almost definitely require a SCOTUS ruling. However, it certainly opens up an interesting line of questioning about why Trump never "mentally declassified" anything until it just so happened to be documents that he would get in trouble for possessing.
It could also be used to set a perjury trap if someone like Kash Patel flipped and is willing to testify that Trump did not believe these documents to be declassified.
