The ND A is invalid, most likely, so the terms are invalid. If Trump feels it is valid the remedy is the court this a suit. Discovery, depositions, all that stuff.

If one party feels that the other party is violating a contract the only remedy is the courts. In a contract a judge can enforce the terms of the contract. Or, a party can seek the courts to render a judgement on all or parts of a contract. Happens all the time.

The courts decide when the parties cannot agree on what the contract means, or if it is even a legal, valid contract.

I suspect that Stormy's law team found an error in the contract that makes it null, and nonbinding.

The courts will decide, unless there is an out of court settlement.

Simple.

Trump or his organization is not involved in the law suit. The lawyer is suing her per their agreement. And he claims he can show 20 violations of the agreement meaning she owes 1 million per incident. Trump won't be interviewed there will be no discovery involving Trump.

This lawyer at the time worked for Trump entertainment and has investments in the company his argument will be that he was protecting the Trump brand to protect his investments.

I however don't believe him and think he told Trump but proving that would be difficult if not impossible.

Doubtful.

And when all is said and done it will go to the supreme years from now after appeals. With Trump likely to replace several more supremes, do you honestly expect this to go against him?

Holy crap! You guys are complicating the crap outta this situation. This is a pretty cut-and-dry contract law situation. The NDA is either valid or not. If it is, Stormy gets sued to death. If it's not she can sing like a canary without fear. The parties entered into this NDA using pseudonyms. Those pseudonyms are filed with the Court in order to identify --- to the Court --- the actual parties to the agreement. The claim being made is that the NDA is not enforceable because it was never duly executed. Trump's side never signed the NDA. It's either executed or it's not. The rules are very clear on this.

Plus she's offered to pay back the amount, pretty much implying that the NDA is valid. Why would you payback something in order to talk if the agreement wasn't binding in the first place?

If she were smart, she just would have asked for more money........

Stormy may have filed a Complaint saying that 'DD' is 'Donald Trump' and that she is 'PP,' but she has no way to actually prove that. Trump didn't sign the 'Side Letter' and it required his signature and delivery to Stormy's attorney -- so it's invalid...worthless.

HOWEVER, the NDA, itself, cannot be assumed to be invalid just because it lacks a signature. The terms did not require Stormy or her lawyer to be provided with a copy signed by Trump/DD.

The NDA is so iron clad, thorough, and specific...there's no way Stormy can wiggle out of it.

In fact, the agreement suggests that Stormy will have to turn over all the donations to her legal fund(s) to 'David Dennison,' eventually.

Anyone donating to Stormy's legal fund is effectively donating money to 'David Dennison.'

I think Trump is probably enjoying this very, very much.
