Hey if gays can sue a bakery for not making a gay wedding cake, you should be able to sue for not making a confederated flag cake.

i can totally see bertha behind the counter at the wal mart bakery having absolutely no idea what either flag looks like.

What grounds are you getting discriminated against on the flag?

Who are they making it for and denying it to others, that is how it works.

When they don't do it for anyone it is hard to show discrimination.

And as far as the Confederate flag and Walmart goes: the demographic that will be pissed off about Walmart not selling battle flag paraphenalia will still keep shopping at Walmart. Hell, in a lot of instances they'll have no choice. A lot of the demographic that might be convinced to stop shopping there because of the flag live in places where they do have other choices.

The wedding cake is gay too?

Two different issues.

One is the business not agreeing with the lifestyle of the customer, thereby refusing service. Cake has nothing to do with it.

The other is refusing to make a likeness of an image that not only offends people but also that the COMPANY ITSELF has decided to no longer carry.
