Look the prisoner will be notified at noon on the day of his execution, this means no matter what day the judge chooses the prisoner will not be surprised at all. On Monday by 11 he'll expect to be executed all the way to Thursday and if he makes it that far than it will certainly take place on Friday. The time of notification makes this a paradox and not necessarily the day chosen, or the day would simply be either Monday or Tuesday.
