This is interesting, because now any facility cannot determine a individuals gender based off genital status alone, but must take into consideration the inmates own views regarding his or her own safety.

Regarding housing and showering decisions, the rule summary states, "In deciding whether to assign a transgender or intersex inmate to a facility for male or female inmates, and in making other housing and programming assignments, an agency may not simply assign the inmate to a facility based on genital status.


Also regarding searches and physical examinations, conducted on transgender people, a complete ban has been imposed on security staff from utilizing such inquiries to determine sexual status.

Agencies must train security staff in conducting professional and respectful cross-gender pat-down searches and searches of transgender and intersex inmates


So according to the statement below, if someone goes into a jail or another facility, and are at intake, and they tell the staff their a woman when really, at least physiologically speaking they are male, will they be able to be housed with woman?

Asked about this provision by Metro Weekly, a senior DOJ official said, "With regards to transgender inmates, the general assumption -- and this is discussed at some point in the broader 270-page document -- is that the rules of the housing unit would apply. If the inmate is in a female housing unit, then the rules that would apply to other female inmates would apply. If the inmate were in a male housing unit, then the rules that would apply to male inmates would apply. In other circumstances, at intake, for example, staff should ask, make their own individualized assessment and take into account the preferences of the inmate to the extent possible when conducting the search."

woman thinks she is a man and goes into the men's jail... gets raped.
man thinks he is a woman and goes into the women's jail... gets raped.

I thought they just lumped these high risk people into special protection housing with child molesters and gays.
Blurring the gender line even more.

I'm pretty sure the prison inmates set their own rules anyway. Eliminating Prison Sexual Assault? Don't think that's ever going to happen. Are they aiming for votes?? Guess not, Felons can't vote. Gotta wonder about this one.

Reminds of a Nat Geo special on our prisons I watched awhile back. They interviewed a couple of male inmates who intentionally take on a female persona and use it to their advantage in a variety of ways. It was rather disturbing.

Wrong it is entirely dependent on what state you are in whether or not you can vote. There is no Federal restriction.

As to the topic itself, it is something that makes sense but as you point out how do you ensure someone isn't lying about their orientation? And this doesn't really address any of the major problems with the prison system as a whole.

Hmmm odd. I get something totally different from everyone else reading this.

No one wants to go to Prison and get raped. If there is any justice in the world, many of our Government Officials will end up in Prison. We know and they know it. So it is only natural for them start covering their bases now and doing what they can to make sure they are not butt buddy of cell block D
