I know we're not supposed to use copyrighted music in our podcasts, but can we use it in backgound or effects?

The reason I ask is the local TV news uses copyrighted music all the time in segments and packages.

Are we news?

Im not sure about the actual price, but a fee is paid to liscening agencys, such as ASCAP, by TV and radio stations and bars where copyrighted material is used.

We shouldnt use any copyrighted material is my understanding.

Does this mean we can use exerpts of music?

"If your podcast features entire music selections, you must either have the rights to distribute the music, or it must be designated podsafe music with appropriate credit added to your podcast thread (created when your podcast is uploaded)."

I think 15 seconds is the limit for using excerpts of copyrighted material.

You can also use royalty free music:
magnatune.com...
incompetech.com...

Be sure to follow their creative commons license.
(mention their name, usually)

And free sound effects:
www.stonewashed.net...
