I fear in a few short years that purchasing a firearm will be almost impossible. A State Supreme Court is allowing firearms manufacturers to be sued because their product was used in a crime. If this succeeds you can kiss US gun manufacturing bye bye.

This new strategy of circumventing the protections in federal laws that shield gun companies from litigation when their firearms are used to commit crimes will very likely be employed by gun control organizations across the nation.

Next step, lawsuits on firearm sellers and ammunition manufacturers.

www.nytimes.com...

The Connecticut Supreme Court dealt a major blow to the firearms industry on Thursday, clearing the way for a lawsuit against the companies that manufactured and sold the semiautomatic rifle used by the gunman in the massacre at Sandy Hook Elementary School.

The lawsuit mounted a direct challenge to the immunity that Congress granted gun companies to shield them from litigation when their weapons are used in a crime. The ruling allows the case, brought by victims’ families, to maneuver around the federal shield, creating a potential opening to bring claims to trial and hold the companies, including Remington, which made the rifle, liable for the attack.

As for the decision issued Thursday, lawyers for Remington, as well as other gun companies named in the suit, did not immediately respond to requests for comment.

It will either get defeated at that level or go to the Supreme Court and be defeated, otherwise the plethora of new lawsuits will bankrupt every industry in the country. Think of all the people who could then sue an automobile manufacturer when some drunk asshole runs over a loved one.

US SCOTUS will slap this ruling down almost immediately, as it is clearly Unconstitutional and stands in direct violation of federal law.

Neat, lets sue all the food manufacturing companies for making people fat and causing death.

I highly doubt purchasing a gun will become "almost impossible".

Just a hunch.

Or sue the beer company because use of the product caused a fatality when a drunk kills someone.

Right?
It's just nonsense. Much like suing the tobacco companies for people dying from smoking.

That's not apples to apples, the tobacco companies actually sat on studies which showed the dangers and then claimed there were health benefits. Firearms manufacturers don't make any such claims and we all know exactly what a firearm can do to a target.

Not to mention the alcohol company that produced the booze, the pharmaceutical company that made the sleeping pills some dipseydoodah used to off him or herself with, the baseball bat manufacturer who made the bat some piece of crap used to bludgeon a shop owner with when robbing him, the knife company that made the knife used by some illegal alien to kill a guy, etc, etc, etc... The only real issue with this crap is it all drives up prices because the manufacturers have legal bills to pay to fight this retardation. It would be nice to see Congress pass a law that states the cities, states, and individuals who bring these lawsuits against manufacturers must start an escrow account prior to bringing the lawsuit or any other case that fully covers the predicted legal costs of the manufacturer plus 50% or the case isn't even heard. Then, if the city, state, or individuals lose the case, the account is entirely handed over to the manufacturer to ensure the consumers aren't stuck footing the bill for this retarded nonsense.

That one is a little different, the tobacco companies spent decades saying their product was safe and didn't cause health problems when they knew it did.

I don't think any firearms company is telling their purchasers that firearms will not harm people (themselves or others).

Since we know this will not get past the U.S. Supreme Court, my question would be why?

Why would the Connecticut Supreme Court be so dumb as even to try this?
edit on 15-3-2019 by highvein because: (no reason given)

///because fighting it cost the firearm industry money. The left is trying the death by 1,000 cuts attack against them with this retarded nonsense.

Probably because there isn't a state law in place that mimics the federal protection. If so there would be no reason to refuse it. They may be allowing it knowing full well it will make case law barring further law suits.

Hence the big push by the major auto manufacturers toward autonomous cars.

Drink all you want, cybercar will sense the alcohol on your breath, lock you out of the controls, and drive you safely home, unlocking the doors only once you’ve arrived.

That doesn't exist now so they could still be sued if this case goes in favor of the plaintiffs.

The school is more responsible for this happening than the gun makers, and in the parkland event the police are even more responsible than the gun manufacturers.
As stated above, this will lead to car makers ,alcohol producers, hammer makers, knife makers.....anything that anyone uses to kill someone will be open game for the lawsuit happy.
