Okay, I found a more mainstream source for this, apparently the OP article is from an op-ed (opinion) section of "risenews" which has the tagline: "Changing the world one snarky headline at a time". Pretty clear the website's goal is to illicit an emotional response from people, rather than represent the views of actual Democrats or more socially liberal people nation-wide.

Anyway, apparently the guy has an IQ of 73:



Rodriguez, who experts say has an IQ of 73, was asked by a prosecutor in a federal court competency hearing this week whether he knew he had committed a crime. “Not at the time,” Rodriguez mumbled on the witness stand. The prosecutor then asked him if he knew what child pornography was, and he blurted: “underage porn.”

Notice how he still knew what it was though? That makes me raise my eyebrow. He knew what it was.

Look, the stuff is illegal and cracked down on pretty hard without predjudice. You just don't stumble onto this stuff, you have to seek it out. It didn't just fall in this guy's lap -- he went out looking for it specifically.

Now the IQ thing...IQ tests have come under more and more scrutiny for their effectiveness. I don't think we can use an IQ test alone as a metric of this guy's mental capacity to comprehend his crimes.

In either case, the guy was intelligent enough to use a computer to seek something out that isn't easy to find. Did he know it was wrong? I honestly don't know, look at what he likes to do apparently:



He also has no outside interests, such as driving, dating or getting a job. Valdes said his only interests are watching cartoons for young children, playing video games and looking up child pornography — though he does not have a “deep understanding” as to why he got in trouble.

So he lives at home, plays video games, watches kids cartoons, and looks up child porn...Where are his parents in all of this? Apparently they did step in at some point:

Okay, so his parents caught or were aware he was using the computer to look at child pornography. I think the parents have a bit of responsibility here as well. They obviously enable this guy who has the mentality of a 10-12 year old. The feed, clothe, and provided a computer with internet access. Just like you would monitor your child's internet activities, these parents should have been monitoring their son's activities.

The internet is full of predators, and that simple fact alone should have made this guy's parents put safeguards on the computer to keep him away from sites that could harm him, or enable him to cause harm. Just like you would look through your kids browser history, they should have been doing so with this guy. They should have put a stop to it the very first time he tried to look for it.

As I said, you can't just type it into Google and find it, so he has to do some internet gymnastics to find this stuff. Compared to anything else you can search for, it's a bit harder to find. One would think this would kind of hint at the face that it might not be something that's OK to be searching for.

I say he's an adult, he went out of his way to find it. His parents were neglectful and even enabled him. It doesn't matter if HE knows it's wrong, we as society have decided its wrong. This guy should be tried as a normal adult, if nothing else to serve as an example for parents with adult children who have severe mental deficiencies.

These parents need to understand that their kid may LOOK like an adult, but they're not -- they're still mentally a child, and they need to be parented like a child for the rest of their life. This wouldn't have happened if this guy had better parents that treated him like a child.

Well, he's not watching teenage porn and this isn't the first time he's caught. Last year he was busted and placed with his parents. He was supposed to watched and not allowed to use a computer. His parents failed.

I do get the difference between looking at a 10 year old vs an 18 year old one is legal the other is not.

I know who Traci lords is and I am aware of her past does it make this right? Because in my opinion no it doesn't, I enders and that she made a choice to lie about her age to work in the business, most children involved in the "industry" are not given that choice but are either forced into via a relative or via the sex trade. Allowing for a viable market for this is just wrong and allowing people to get away with having it or watching it is a slippery slope regardless of mental capacity.

I would think his tastes ran more to the post pubescent.
I could be grossly wrong here, but I have not seen an obvious community of illegal pornography on the internet. Granted I have not looked for it, but once again we are talking about an individual with an IQ of a 12 year old. How could he find such an illicit community?

From my personal experience people enter the sex trade by choice. Granted I only know one retired porn star, and one prostitute.
I also know 4 past exotic dancers, who paid for college dancing. Every one of them made the choice, and every one of them has no regrets, that they've told me.

His father recognized it as child porn. If he were watching teenagers I doubt his father would have been so quick to identify it, especially considering how fast children grow these days thanks to our food. He knows sex between a man and a child, not teenager, is wrong. He has an IQ over 70 and has no problem surfing the net. He went to high school, although he was misdiagnosed with ADHD & had a GPA of 2.0.

The federal prison he was in held him for 4 months and the federal doctor said he is fit to stand trail. A doctor who volunteered their services says he isn't fit to stand trail. Either way, he is very high functioning and I believe since his parents completely failed to follow the courts orders the first time he should be placed in a group home that can follow the orders. He shouldn't be sent to prison.

OK maby I have a little insight on this
My cousin is autistic and my sister me and my mom raised him he's about 16 now

1st the way u access such port CANOT be filtered this is not Firefox it's the dark Web

I know my cousin never umm gratified himself to porn as he didn't know how even at his current age

So this may not be sexual but I don't know

The minds of autistic people DO NOT work like the rest of us at all

A iq test is in no way the maturity of the mind 5 yr can have a 150 iq dose that mean they understand sex

I sympathise with the parents the fist time I cought my cousin I put a simple block he bypassed it I put up a better one he got around I cut off his net well now he lost job
His only connection to the world and truly didn't understand why even when I told him he didn't understand why

Next even tho his condition asbergers happens count be a computer genius

To actual put the poor kid and yes he is a kid age means nothing is wrong

Phisicaly punishment works better and I don't mean pain but work

My preference punishment for my cousin was extremely hard phisicaly labor

Why can pain puts him in panic mode and he do sent understand it but digging a hole is not so stressful and he learns from it

U absolutely CANOT punish people like this in the same manner most don't understand pain

Sure, his parents should have been parents, possibly preventing this from happening. Since it happened before, and he knew it was wrong, and still went out of his way to find it -- he's guilty, and should be tried as an adult.

Note that I didn't say I think he deserves the same sentence a person with an average 100 IQ -- but the guy needs to sit in the witness stand in a court room, and face a real trial just like any adult.

I'm going to be pissed if he gets more than 5 years in actual prison though...Look at what Subway Jared got for his proclivity for little kids -- just shameful.

It I was the judge, or on the jury -- I'd be in favor of him becoming a ward of the state and put into a medical institution for a sentence, hopefully working with psychologists and psychiatrists to make him a more productive and independent human who can function within the law.

Problem is...we don't have these types of places anymore. So ... I'm not sure what to do with this guy. He's not going to "learn his lesson" sitting in a prison with hardened criminals.

I can only agree to a point insitutions will only confuse him most likaly

For example something as simple as music and confuse and scare autistic people to the point of being frozen in fear imagin a straight jacket padded room and some benzos

We don't have a system for the public for this out mental hwlth system is more of the thing of nightmares than help

If he was watching child porn he is guilty and should get the help and treatment he deserves. Prison no but help yes.

He was able to figure out how to use specific browser settings and find websites that are deliberately hidden for child pornography, I think this guy isn't as disabled as he seems.
