Yeah, he should go to trial, I don't want to see this swept under the rug or excused, but trying him as a normal adult to me suggests that you want him to be tried as a normal adult. So if tried as a normal adult, he wouldn't be offered any consideration for possessing the mental capacity of a 12 year old. I'm not much for semantics usually, but in this situation I think it's important.

I'm not intending to sound snippy, but if I hear someone say he should be treated and tried as a normal adult, and to ME it sounds like saying treat the guy with mental issues the exact same as 50 year old man with no issues, give them the same sentencing and mental deficiencies don't matter.

It really all depends on where they fall on the spectrum, every case is unique with some are obviously more sever than others. I have to admit that some fall into the category that you are talking about where as others would not.

If this "man" had stuck an ice pick in his mothers neck and killed her would people be putting up the same arguements? This is a clear case of right and wrong, child pornography is wrong, no if ands or buts about it. Should he spend time in prison, no he should be taken to a mental care facility that can help him and possibly help to rehabilitate him and help him to re intergrate into the world.

A couple of things , im pretty sure 12 year olds have IQs higher than 76 or whatever the number is , age needs to be taken in to consideration when determining IQ . Maybe if a 12 year old was given an adults test it might come out at 76 . Secondly , looking back my moral compass was firmly set at 12 , 10 perhaps not so much . But how was he accessing this stuff , me thinks his parents might no be the innocent victims in this .

So average IQ is 100... This is a man with the mental capacity of a 12 year old, and a very low IQ for a 12 year old. Mental maturity and intelligence quotient aren't the same thing.

You could have an 8 year old with an IQ at 150 and they still would have the mental maturity of an 8 year old. As in poor impulse control etc.

This guy is not at all an adult, he's a borderline retarded 12 year old. Either one of those make me think it's unacceptable to treat him the same as an adult, combined he's really not fit to be tried as a normal adult.

I tend to agree , its just a pity that the way they categorised him is a bit misleading . Does he deserve an adult prison sentence in an adult prison , no . What the answer is i am not sure , he is in a different country to mine and im not even sure what the Australian authorities would do . I do know we still have facilities here for mentally challenged/unstable people who are a danger to themselves and others .

I understand, no offense -- We're kind of in the same boat actually.

Prison isn't going to do anything...it'll just mess the guy up more. I still think a "normal" adult trial should happen, it might be a good learning lesson about the real world.

As I said...its unfortunate we don't have a place where he could be held and worked with by professionals. I bet if given the time and right phsych professionals -- he could come out of this more social, and even have a better grasp over things that are right/wrong.

That's how I'm feeling too.

I do know we still have facilities here for mentally challenged/unstable people who are a danger to themselves and others .

I actually have no idea what sort of facilities we have in place for this kind of situation.

I'm not entirely convinced that a person with these mental issues is actually a threat based solely on the porn they were viewing. I don't think that masturbating to certain things automatically makes someone actually violent. I don't know if the guy should actually be institutionalized, or get some therapy.

I just find it very distasteful seeing people saying things like "He should be locked up and whatever happens to him I don't care, the worse the better." We're not dealing with someone that's all there.

I think most of us usually are. Glad no offense. I don't think you're some terrible retard beating monster, and I doubt you think I'm some sort of child porn apologist.

I look after a guy with autism who is attracted to underage girls. He doesn't have the capacity to know it is wrong but we have many protocols to make sure he is safe and everyone else.
It is about capacity...If he has it then punish wiith jail If not he needs to be monitored and put in a place which would help him.

My gradeschool had a special ed class, maybe 20 kids? We all volunteered as aides to help during lunch and recess to help, so from an early age I was exposed to people with physical and mental disabilities. I actually think it was a really good thing for my classmates and I to be exposed to.

These images don't just magically appear on your computer. I am a highly intelligent individual and I wouldn't have the first idea how to find images of that nature. Granted I am nearing 50 but I can't imagine this autistic persons found them by accident. Someone either showed him how to get them, gave him the images, or he is plenty smart enough to know better because he found them on his own.

Bullets are cheap and there are lot of swamps full of gators in Florida.
