Typically, the mortgage lender who is servicing your loan is NOT the one who originated the loan. This is GOOD news for you and BAD news for the mortgage servicing company.

Chip Parker, Jacksonville Consumer Attorney makes some key points about mortgage lenders and foreclosures.

“Does your foreclosure complaint even have copies of the note, mortgage and assignment attached? Most likely, these documents are not attached, and may not even be in the possession of your mortgage company, “says Parker.

For all the foregoing reasons, the above-captioned Foreclosure Complaints are dismissed without prejudice.

It seems to me that all citizens (not just those in financial distress - Come Oct 1st) may be able to renegotiate the terms of their mortgage.

Mortgage notes have been spread all over god's creation. No-one knows who owns what.

This has actually emerged as a very real problem. I've been reading articles for months now that indicate many judges are dismissing foreclosure suits because of the note holder's inability to produce documents.

Sloppy. :shk:

Just goes to show how out of control everything was....

Something has to be done and done soon, so far about one million people has received foreclosure notices in the US, in Florida alone 1 in 60 have received foreclosure notices.


U.S. foreclosures in the first quarter more than doubled from a year ago, with one in every 194 households receiving a foreclosure filing in the three-month period

46 out of 50 states and 90 out of the country's 100 largest metropolitan areas are seeing an increase in foreclosures

3 out of every 1000 homes have been repossessed nationwide due to foreclosures in first quarter 2008, up 71% from a year ago

Las Vegas, Miami and Phoenix all saw housing prices plummet by at least 20%.

Right now in my neck of the woods the government sponsored housing complex are full and the list of people waiting for housing is just growing.

Marg check this out. Food banks are shutting down due to diminishing donations and rising costs. It's not just this one foodbank either.

Now lots of homeless and hungry people are roaming the streets at night - Sleep tight.
