Anyone who looks at Alex Jones knows he will fail that test. I'm all for having him take a breathalyzer. If you don't have one, fine, bring him in for one. After he tested at 0.076 you say sorry Mr. Jones, you're free to go.

If his BAC is less than the legal limit he is not intoxicated unless his driving showed signs of impairment. So if he was swerving lanes or driving recklessly/dangerously then there would be some meat. He was not. He was pulled over for going 5mph over the limit, nothing else. The original complaint of why they went out was not what he was arrested on.

Texas Law enforcement officials do not necessarily need BAC test results to charge you with driving while intoxicated. They can charge you with DWI in Texas even if your BAC test results are under the legal threshold for driving while intoxicated. You can be convicted of driving while intoxicated in Texas based on other evidence that demonstrates you were unable to safely drive your motor vehicle. Source

Which is why I specifically pointed out the cops that pulled him over found no issue at all with his driving. He was safely driving his car when pulled over. The only issue at all was he was going 5mph over the limit, which was simply a pretense for pulling him over.

They can claim that, it will never hold up. Those tests are designed to make people fail and one look at Jones is enough to tell you he probably won't pass.

The cops followed him, they noticed zero impairment. His BAC was less than .08. Anyone in that position should be sent home with an apology.
