There are checks and balances that are supposed to work for the rights of the no wrong doing citizen....not the criminal. As posted in a recent thread, the cops shut down a entire intersection and handcuff everyone. Tell me where the balance for our rights are under that premise?

The police IMO have become to comfortable with shooting first and asking questions later. I applaud this law. It maintains that we cannot be shot due to a police mistake for no good reason without repercussions.

This is great news. As previous posters have pointed out, police are going to have to ensure they're at the right place and after the right people. Living in the People's Republic of Illinois, I'm happy for neighbor's to the east, and hope some of their common sense blows across the border here.

police should be no different than citizens when it comes to accountability and responsibility for criminal or civil crimes. they should have nothing the citizen doesn't, because the constitution states citizens are the power of this country and not the govt.

police are a farce sold to the public in any event. they have become nothing more than revenue generation for municipality's, they don't protect and they don't serve anyone but themselves and the cost is tax dollars and great loss of liberty.

what would life be like without police, it would be far better because citizens can deal quite easily with crime ourselves. if community's, neighbors and such band together crime would be no worse and i would imagine far less, then we have today.

And there should be door signs. Maybe a reprint or synopsis of the law, something you can put up on your door by the "solicitors will be shot sign" to remind the cops to double check the address.

Cops storm wrong house (armed fed judge, oops)




Personally it seems like the neighbor was trying to start a gun fight between a judge and the police department. The caller called both the police and the resident. Getting them both alert and armed. This goes to show you at any given time in this country almost no matter who you are. You could be looking down the barrel of a police officers gun and be completely innocent. This happen last week the lady wasn't a judge and they shot her dog. There was an ATS thread about it. I suggest reading the article.

Are you currently on active duty US Navy or former? Operations Specialist by chance? If so there might be something I can do for you if you would be interested in Southern Arizona (which has awesome gun laws, or should I say LACK of laws with regards to it's armed law biding citizens which is one of the primary reasons I moved here upon my retirement from active duty).

I have to disagree with this. The entire purpose behind LEO's is to prevent rebellion. Anyone trying to stockpile arms for an uprising is quickly dealt with as if they were a criminal, not someone trying to protect the people from a tyrannical government. In this regard the governments use LEO's to maintain it's "law and order" and just what do you think will happen when said tyrannical government begins to amend your Bill of Rights to where it benefits said tyrannical government and not the people? That government will not long after that become a dictatorship and then communist and that is exactly the direction we're heading to right now. If you compare Ancient Rome with the modern U.S. we are walking in Rome's footsteps to the point we're mirroring the Rome of the Caesars and we all know how that ended.

Once you know that it's the police, you no longer have the right to shoot away.

I imagine you will see alot more prominence and overwhelming force now that this has passed because they will want to make sure everyone in the house to be breached knows,
clearly,
that the po-po is a comin'. I imagine lights, sirens, bull-horns, and waking the whole neighborhood to serve their warrants. Set up real quiet, then BANG....lights..."POLICE!" Being repeated over and over as they ravage just as always...just a little more shouting of the word police.

I don't doubt that for a minute. If they know people are more likely to shoot back, all the more force they are going to bring on entry.

I say stop these raids entirely. Only in the most severe of circumstances, and only with key approvals.

It really is that simple.

I live in an area where every residence has (and I'll use a newly coined Aurora Police Chief term) a "virtual certainty" firearms are present, and ready to be used. Police generally know better than to no-knock without being DAMN WELL SURE they got the right house.

Honestly, I don't know anyone that doesn't own at least a shotgun. The police here are not stupid. (afaik

On the downside, the police in Indiana will probably be a little more "jumpy" to say the least. Though, they'll be far, far more reluctant to busting down doors.. which is always a good thing.

Why would you want to leave beautiful California to move to some turd in the rust belt? Granted this law looks good on paper, but I am positive that there is much interpretation to be left open for the judges and courts to determine when their first case arises...Police will always have some form of immunity.

This law was in response to a horrid court decison making it legal for cops to burst in on folks with no knock warrants and too damned bad if it was the wrong house. As a Hoosier, I am THRILLED that this law got put into place. There is no downside to this that is half as grotesque as the erosion ( or complete annihilation ) of our 4th amendment rights. Militarized police are a thing to fear and loathe and any steps taken to roll back their power are to be applauded. Loudly.

Indiana is quite beautiful, with rolling hills, lush forests and shining lakes and the part of the state I live in is the most manufacturing heavy congressional district in the nation. So if Indiana is a " turd in the rust belt " that certainly must make California something a whole lot worse.

It loojks great on paper but all the paper allows now is for a solitary person to stand against the storm.
While I'm sure I'd do fine vs 1 or maybe even 2 assailants.....err officers.
These animals always hunt in packs, 5 in the front door and 2 in each window.
Even if you have the "right" to defend yourself, 1 vs 20 is hardly fair.
So we now have the right to do exactly what again?
I say a better option would have been officers and supervisors that are fully accountable for their actions.

Bad premise. With no-knocks, they don't give the opportunity to open the door, so they'll never know whether the "bad guys" would have opened it or not. On the other hand, if they knock like civilized folk, and no one answers, but they have a warrant, they can breach anyhow.

I can tell you that anyone kicking my door in in the middle of the night, I don't care if they're screaming they are Jesus and all the apostles - there's gonna be some excitement. Just because someone is yelling something at you doesn't make it so. Better show me some paper in a civilized manner. You knock on my door and tell me you have a warrant when I answer, it's all good. I'll hold still for the cuffs. If you DON'T, and decide that yelling at me as my door splinters is the way to go, you get what you get, same as any other common midnight street thug.
