Yaser Esam Hamdi, who was captured in Afghanistan 3 years ago after 9/11, was to be released to Saudi Arabia this past Thursday. Hamdi, who is being held in a Navy brig, in Charlestown, SC was able to call his parents for the first time in 2 years.

NORFOLK, Va. -- After three years in custody, Yaser Esam Hamdi finally got to call his parents and watch some television. But he's still waiting to go home.

Hamdi, a U.S. citizen captured on an Afghanistan battlefield, wants to return to Saudi Arabia, where he grew up, and Secretary of State Colin Powell says he expects U.S. and Saudi authorities will be able to resolve differences to make that happen.

Although, Hamdi was supposed to be released on Thursday, it is not known why there has been a delay. It is now being reported that Sunday will be the earliest day for Hamdi's release. There was allegedly a "snag" in discussion with Saudi officials.

The Supreme Courts decided that President Bush could not hold wartime combatants without trial or charges. There were no charges brought against Hamdi, although he will not be permitted to leave Saudi Arabia for 5 years, or enter the United States for 10 years. When his 10 year denial of admission into the US is over, he will then need special permission to enter the US.

The Saudi government believes that Hamdi should be released without any rules because he did not break the law. They are calling the deal "unenforceable."

I honestly do not understand why any american citizen captured in battle against the US should be allowed to go free. I also don't understand why Irregulars caught in military operations need to be given trial or let free either, the British kept captured Boers in prison camps permanently (unless they signed an agreement to not take up arms again), why shouldn't the US?

However, I think a US citizen captured there should be tried in court. Taking up arms against the US is treason, and they should be executed for commiting it. If the government can't demonstrate that a person was actually fighting for the enemy, then why hold them at all? On the other hand, why would they even bother capturing him if he was doing nothing, it seems like they might not be able to prove to judicial standards that he is guilty, but that they have proved to themselves that he is. Regardless he seems inclined to return to Saudi anyway.
