On Jan. 27, 2010, Mr. Warner learned he was accused of sexual assault by another student at the University of North Dakota. Mr. Warner insisted that the episode, which occurred the month prior, was entirely consensual. No matter to the university: He was charged with violating the student code and suspended for three years. Three months later, state police lodged criminal charges against his accuser for filing a false police report. A warrant for her arrest remains outstanding.

Among several reasons the police gave for crediting Mr. Warner's claim of innocence was evidence of a text message sent to him by the woman indicating that she wanted to have intercourse with him. This invitation, combined with other evidence that police believe indicates her untruthfulness, has obvious implications for her charge of rape.


In finding Warner guilty, UND used the weak "preponderance of the evidence" standard (50.01% certainty) to determine guilt or innocence—an evidentiary standard recently imposed upon every federally funded college in the country under a new regulation from the federal Department of Education's Office for Civil Rights.

The fruits of PC-ism run amok.

Someone very near and dear to me has just lost their job at a local university due to strikingly similar circumstances. He was publicly humiliated by being arrested at work and upon returning to work was told to pack his things and leave with no explanation. He was not even allowed to tell his side of the story.

This is what America has come to and I am beyond disgusted, now we're guilty until proven innocent.

Freedom?! Liberty?! For WHO? The fat cats that continue to exploit everyone else until America collapse under the inertia of debt? They'll just pack up their stuff and move to new mansions in Europe if things fall apart here.
That's the sign I'll be looking for - if they begin sneaking off quietly in the night.
They need to stay and enjoy the show with the rest of us since they created it.
Very, very sad. I never dreamed the United States could fall this far.

The sad fact is that Universities are run like separate fiefdoms with their own sets of rules and laws that certainly do not conform to those seen in the rest of society.

A buddy of mine had a run in with the campus police several years back over a prank he “allegedly” was involved in. They went to the house he was renting with my cousin about a mile off campus. After asking him some questions they told him they were going to take him into custody and take him back to the campus police station for additional questioning. Being no dummy (except of course for the prank) he informed them that their charter did not grant them LEO status off the campus property and that while he would be polite enough with them he would resist any attempt to take him into custody with whatever level of force was deemed necessary. Naturally, there was yelling and even some shoving before the town police were called out. The locals gave my friend and earful but reserved most of it for the campus cops .. mostly because they were armed (my state didn’t have CCW at the time), had been told they needed an escort in cases like this, and were reminded that their LE charter didn’t extend off campus.

The moral of the story is you gotta know your rights, let people know that you know your rights and remind them what the consequences are for ignoring them.
