So now entire states are getting waivers? First it was the house and senate members opting themselves out of this puke of a bill, then the unions all join in and other groups and now entire states. This whole thing is ridiculous. I guess 56 states to go according to Obama. Maine better watch out or the union thugs who screamed for this bill will come leg breaking.


Maine health insurers are getting a temporary waiver from the health reform law's requirement that they spend at least 80 percent of premiums on care, federal regulators decided Tuesday. Maine is the first state to get a waiver. Three other states — New Hampshire, Nevada and Kentucky — have pending waiver applications.

Not that I'm surprised in the ignorance over the Constitution, but this is in complete violation of the equality clause for all states to be treated equally by the Federal government.

If this is in fact true, and a done deal, it will only strengthen the case for the entire law to be struck down by the Supreme Court because not only can you not force people to buy something that is regulated in each state (and not across states), but you also can't give one state a pass on a law and not all of them.

The Constitutional lawyers are going to eat this alive.

It will be interesting to see how this all turns out. The healthcare issue is the one thing that makes me want to leave the country. I won't live anywhere where I am forced to buy a product from a private company or face being treated as a criminal. Canada is looking better & better.

A federal Judge has already ruled the health care bill unconstitutional and Obama is still moving forward with it.

If Bush was doing this he would be impeached.

A federal judge also ruled to lift the drilling ban in the gulf yet the Obama regime drives on. This healthcare fiasco should be fast tracked to the supremes and be done with. None of these idiots read the thing to see what was in it to begin with it was all written by lobbyists and just signed off on. Just read where theres a little diddy yesterday that 12 trilliion or so is set aside for unions health benefits to be paid for if they decide to retire early too.

What a joke this entire thing is. Over 1000 waivers granted and now and entire state because the state does not enough insurance companies! What do you suppose that Wyoming, Montana, North Dakota are doing as we speak? They are using this precedent and are going to work for an exemption as well.

The entire plan was socialist by definition -- that being that by forcing everyone into the system, the collective costs could be covered. Every waiver erodes the plan. Not only that, there are more than a dozen explanations for the granting of the waivers.

Looks like we won't need those 1000+ new IRS agents to enforce the individual mandate. By the time these jokers get done handing out waivers, there will only be 1000 folks who actually are required to abide by that provision of the bill.

First of all...this is a completely different issue and they are completely different waivers.

And these are going to insurance companies to comply with a part of the law...not to individuals to comply with a part of the law. So your title should really read "All insurance companies in Maine".

But it seems like ATS is the place to spread mis-information...and for all the self-proclaimed "critical thinkers" here...it still gets eaten up.

It does not matter who the waivers are given to and for what reason. The administration has publically stated repeatedly that absent the individual mandate the law as currently written can not stand. The entire financial house cards will fold in on itself.

Each waiver creates more precedent for others and even of the Supreme Court rules the law constitutional, there will be tons of law suits claiming unequal treatment under the law that will wind their way up to the court.

The thing is dead and the administration should pull the pin on it rather than causing it to die a death by 1000 cuts.

Hello HoldTheBeans,

The State of Maine is exempt from the new heath care law. That is great news. Now everyone needs to let the Feds know they consider themselves to be a resident of Maine, temporarily living away from home and exempt by virture
of their intention to return to Maine someday soon.
