A federal appeals court on Tuesday struck down a key part of Arizona's law requiring voters to prove they are citizens before registering to vote and to show identification before casting ballots.

The decision by a three-judge panel of the 9th U.S. Circuit Court of Appeals found the law requiring voters to prove their citizenship while registering is inconsistent with the National Voter Registration Act. That federal law allows voters to fill out a mail-in voter registration card and swear they are citizens under penalty of perjury, but doesn't require them to show proof as Arizona's law does.


This is absolute madness. So now Americans have to take it on someone's word that they are a citizen and eligible to vote? These are the same folks who lie every day about being illegal immigrants, and now they will be able to vote in US elections, based upon their "honest word"?

I thought it was a basic requirement in EVERY country in the world that you are to be a citizen in order to vote? Apparently in the USA this is discriminatory against people who aren't US citizens? What a crock!

Therefore, if this is correct, what rights exactly does being a US citizen give you now that an illegal immigrant can't get?

They MUST be joking. Time for term limits for all political offices, INCLUDING judges.

I'm now REALLY glad that I don't live in the USA. No wonder the American Presidential Debates are in English and repeated again in Spanish, even though a requirement of citizenship (that is usually required to vote) is that people learn English. Now, they can talk to the Spanish masses (13 million illegal immigrant voters now) and convince them to vote illegally.

Seems to be the new rule of law here in the good ol US of A. Don't need to be a citizen, just need to swear that you are. Kind of reminds me of the banks... don't have to hold the mortgage, just need to swear that you do.

Seems appropriate the Feds would interfere with a state to write or enforce their own laws, again they did the same when the fraudulent mortgage loans started. Individual states tried to enforce laws on their books when they saw what was going on and the Feds stayed that too.

Wating for people here to remember this nation is a republic... individual states DO have rights. NVM, guess it's like individual rights, the proper term would be DID.

whats the point of having state courts, when everytime we vote for something it gets struck down?


any bets on the next overturn? i got $5 on prop 19 in california.

it makes perfect sense, if people had to prove they are citizens to vote, then voting fraud like the one that got george bush elected would almost be completely eliminated.

so next time chuck e. cheese votes for governor he would have to actually show up and produce identification.

I am not sure about where you all live but I had to be a citizen to REGISTER to vote. That is the only way I can vote, by being registered. If someone asked me to prove my citizenship at the polls, I would be a little more than perterbed that my precious time would be taken up to attempt to convince Joe Shmoe volunteer to accept my proof of citizenship. Where I live, they do not issue long form birth certificates so god forbid Joe just happen to be a birther with no sense of reailty. Poll workers are not experts in citizen documentation anyway.

Liberals have selective memory voter fraud got a crook name Kennedy elected President.

The family even joked about it at family get together's.

They bought Chicago,which is not surprising.

This country elected a Kenyan President,so why is it not surprising.

The Arizona law should be re-written.

You do not have to prove you are a citizen.

You have to prove you are not a legal or illegal alien.

It is all a matter of semantics

All this attack on one state will lead to eventual disembowelment of the union.

no biggy. just start prosecuting the non-citizens who sent in cards to the full extent of the law, perjury. their numbers aren't big enough now to make a huge different in elections and put a few away for some years, make an example out of them, and i'm sure very, very few will try again.

I don't actually see the problem with providing ID to register to vote? I myself am working class but I do not seem to have much of an issue providing ID. The title is misleading though as voters still need to prove they are citizens:

The 9th U.S. Circuit Court of Appeals' invalidation of requirements for proof of citizenship comes too late for any prospective new voters who were barred from registering before the deadline for the November 2 U.S. mid-term elections.

The state denied registration of an estimated 30,000 Arizonans who failed to prove their citizenship during the first four years of the law, said John Greenbaum, legal director for the Lawyers' Committee for Civil Rights Under Law, one of the groups challenging the statute.

The appeals court is slated to hear arguments next week in a legal challenge to a separate newly enacted Arizona law requiring state and local police to check the immigration status of anyone they suspect is in the county illegally.

SPLIT DECISION

The Tuesday ruling stems from a ballot initiative, Proposition 200, Arizona voters passed in 2004 requiring individuals to produce proof of citizenship, such as a passport, to register to vote, and a picture ID, such as a driver's license, or two pieces of non-photo ID, in order to cast a ballot.

Read the article, you still need to provide ID at the polling stations. In addition to that there have been many voters in Arizona who have provided bank statements and bill statements as ID's and have received little to no issues. So I do not see the issue as illegals will still have trouble at the polling stations, unless somebody can state otherwise.

The court in this case is looking out for honest and legal American citizens as since I have to say it a majority of the surrounding area of The Mojave Desert is Hispanic and can and more then likely have been unlawfully detained using said law hence the striking. The fact The US Circuit Court struck it down in Pheonix of all places effectively is a statewide decree and mandate that this practice is hereby in "retainership pending review". Meaning more information is possibly needed in order to make a final ruling on the matter. This is merely an injunction and the complaining party does have the right to seek that the case be heard by a higher court and their are only 2, 1 The US Supreme Court and The Arizona State Supeme Court. This was Federal court Feds trump state in manners like this.

"Racial Profiling" in this case is near guaranteed.

Key word of your sentence is "we".

if "we" vote on something and it gets over turned.

The thing that got over turned was a law that unjustly ridiculed and singled out people of a non-white skin tone. It was against the constitution. Just because a bunch of red necks vote to make it law, doesn't mean it's legal to do.

You can bet if the SEIU is involved, then Sharon Angle better call her lawyers to even out the odds against King Harry’s union thugs. CLICK HERE. Oh, keeps reading. It gets better (or worst) in the Nevada. It appears Harry Reid is giving out free food at the polls to entice the voters into pushing the electronic lever for him. Of course, since this is the 9th Circuit Court, would we expect anything less than another attempt to DESTROY the US, and the Constitution. Fortunately, the Supreme Court has a way of slapping down the 9th Court. Why not just dissolve the 9th? I is nothing but a tool of leftists, socialists, and freaks.

Speculation is never proof, but I will agree that people need to show not some kind of identification. Besides, if you'll remember, the Democrats were the ones caught up in false registrations and other illegal activites concerning the vote.

I remember several years ago, an older woman went and voted for a friend of hers and her daughter because they were caught up in something and out of town. She voted three times (once for her, her friend and her daughter). I wanted to report her but i wouldn't have had any proof so I just let it die.

I know back in the 80's and 90's, the polling precincts asked for your registration card and ID for verification. And if you must know, she voted for John Kerry three times because her daughter was a Kerry supporter.
