Supreme Court Won't Order Cheney Papers Released

The Supreme Court refused Thursday to order the Bush administration to make public secret details of Vice President Dick Cheney's energy task force, but kept the case alive by sending it back to a lower court.

Justices said 7-2 that a lower court should consider whether a federal open government law could be used to get documents of the task force.

Wow! An interesting non-decision/decision. As I understand it, the court did not address the issue of whether or not the papers should be released, but instead sent the issue back to a lower court judge with additional instructions.

Maybe the lower court isn't comprised of Cheney's golfing buddies. So they sent it there to avoid more backlash (from the people or Cheney).

You are correct Sir. It does take some of the heat off of the Supreme Court. At least for some time, because it will come back to them.

It seems that once the lower court judge makes a decision (whatever that may be), each side then has the option of petitioning the Supreme Court to review the decision.
