Idaho took the lead in a growing, nationwide fight against health care overhaul Wednesday when its governor became the first to sign a measure requiring the state attorney general to sue the federal government if residents are forced to buy health insurance.

Similar legislation is pending in 37 other states.

Constitutional law experts say the movement is mostly symbolic because federal laws supersede those of the states.

But the state measures reflect a growing frustration with President President Barack Obama's health care overhaul. The proposal would cover some 30 million uninsured people, end insurance practices such as denying coverage to those with pre-existing conditions, require almost all Americans to get coverage by law, and try to slow the cost of medical care nationwide.

Democratic leaders hope to vote on it this weekend.

With Washington closing in on a deal in the months-long battle over health care overhaul, Republican state lawmakers opposed to the measure are stepping up opposition.


Otter, a Republican, said he believes any future lawsuit from Idaho has a legitimate shot of winning, despite what the naysayers say.


Idaho is way too conservative, I oppose the bill too but I wouldn't sue the government to stop it. The feds have way more authority than any state.

Actually, the title of your thread should be, " Idaho Can Sue If They Pass Health Care" because they cannot sue, until they pass it, and only then if they try to enforce it. Also, you cannot sue the government, because it is a sovreign entity, and is therefore exempt from lawsuits. Just a quick note, for ya.

Legal experts say the measure, signed Wednesday, will likely be struck down. But Idaho's new law reflects growing frustration with President Barack Obama's health-care proposal.

Legislation similar to Idaho's is pending in as many as 37 other states nationwide.

Democrats in the nation's capital are hoping to pass health care reform by this weekend.

The American Legislative Exchange Council created the model legislation for Idaho and other states. The Washington, D.C.-based, nonprofit says Idaho is the first to sign a version into law.

I have a feeling the No Standing maneuver will be played a LOT more in the future.

This cannot go to a court, because the court will have to write a decision stating where the Federal Government gets the right to do about a twenty different unConstitutional maneuvers they are either using to implement it, or that are in the bill.

The federal government is broke and they think if they tax us for four years they can dig themselves out of the mess. They are just delaying the inevitable that this country is on the brink of bankruptcy.

Sorry, they start to tax us immediately, but they do not institute anything untill the 5th year. And when all that money they collected for the first 4 years is gone at that time, they will have to raise funds in another way. Welcome to the United Corporatist/Socialist/Communist/Fascist States of the Rockefellers.

Does this not show EVERYONE what this is all about?

C'mon people, I thought people here were more aware of the maneuvers of this despicable government.
