They can't regulate herbs, but they can deem them dangerous and if they can convince enough people that it poses a serious risk to user's lives, they can get it banned.
It's already been outlawed in California. I find it amusing that they only put a limit on meds containing ephedrine, but they completely outlawed the use of Ephedra.
