Ice Hockey: Delay of Game Penalty

I know that the rule stats that if a player of the defending team shoots the puck out of play in the defensive zone that player will recieve a penalty for delay of game.

Heres' the problem that happened, in the flyers, predators game, a predator hit the puck out of mid-air into the seats while he was in the defensive zone, the ruling was that it wasn't delay of game.

What do you think should have happened, correct cal or delay of game.

I say that it should have been called delay of game because he was in the defensive zone and the rules only say it would not be a penalty if the puck was deflected, and the player hit the puck in mid-air with his stick intentionally
