The truth is revealed in the article you linked. The US government never released the relevant information regarding Plame to the public, so assuming the facts of the case that Rove leaked the information holds true, he would still be guilty of being an accomplice at minimum.

Remember that the government decided to persue the Times because they claimed a crime had been committed, and that's the reason this is all a scandal to begin with. The National Review wants to blame the "liberal media" for creating this mess when the reality is it was created by the Bush administration's witch hunt of reporters in the first place for a crime which they now want to say was never committed.
