The only thing that second passenger can attest to is that he heard noise coming from Freddie Gray. Without being able to see, there is no way he can declare with 100% certainty what Freddie Gray was doing.
He can say all he wants that Freddie was banging his head. How does he know Freddie wasn't kicking?
