He avoids prison and has been given probation, and that's only because the state does not want to pay for his medical treatments while hes in jail. He was actually jailed after getting caught but released not long after because his disease is so debilitating.

He doesn't use marijuana to smoke or eat it. He uses the oils to control the massive legions that grow on his body. Without the oils, the legions get out of control. Could he use other medicines? I dunno, but chances are he cannot afford it since he had to move his family into his parents house because of his illness.

"A terminal cancer patient who faced up to 15 years in prison for growing marijuana that he says was used to treat his tumors was instead sentenced to probation by an Iowa judge Tuesday.

The Quad-City Times' Brian Wellner first reported the surprise ruling Tuesday afternoon:

BREAKING: Judge Latham sentences Benton Mackenzie to probation. #mackenzie #cancer #marijuana [via @brianwellner].”

Benton Mackenzie, 48, faced at least three and as much as 15 years in prison, but District Judge Henry Latham instead chose to grant Mackenzie a three-year probation, Wellner reported.

About a dozen demonstrators rallied in support of Mackenzie outside Scott County Courthouse in Davenport, Iowa before the ruling came down, holding signs that read 'Stop arresting patients' and 'Treating illness is a right.’"

Remember, according to our overlords in DC, marijuana has NO Medical use, even though DC is a medical marijuana state... err capitol.

You're so correct. If it's not a medication why do they have their own medical marijuana program? They're such hypocrites. Do as I say, not as I do.

As a medical MJ patient I run into this bias every day in all kinds of places......
The Anslinger mind control (reefer madness)propaganda paid hansome dividends for the PTB....and is still working the ignorant and lazy minds of the so called normal society.....
So many lies told often enough become gospel to some....who then close their minds completely.....
I suppose it save a lot of thinking though.....

While it's something that I've never properly researched was it not the pharmaceutical companies that had it banned originally? I seem to remember half catching a tv program a couple of years back that stated that different parts of the plant could be stripped down to cure all sorts of ailments ranging from a head ache all the way up to the dreaded big C.

The reason its illegal is simply because it takes precious money away from the pharmaceutical companies and the government. Who's going to go to the store to buy pills when you could easily grow your own medication at home?

What's really sad, he definitely can't grow any plants to extract the oil because now officers of the law can and will stop by his house any time they want and they will be looking for those plants. One of the few medicines out there, and free, that he can use to treat his disease has been taken away from him.

He can't even move to a medical marijuana state now thanks to probation. If that judge had a heart at all he would have drop the case.

Another case for jury nullification.....but I suppose a jury trial was not an option?
I definitely think a jury would have acquitted him........

Anyone that questions BigPHarma™ is an enemy of the State... Questions where Your tax $$$ goes? 'enemy of the State' Question why BigBusiness™ is the biggest "socialist system" in the world? 'enemy of the State'

Grow Your own medicine? 'enemy of the State'... In 2004 I was "medically retired" from a Ca. police dep't. as I was injured fighting that other failed business model that gets $B$ thrown at it "The War on Drugs".. When I retired, I was on 7 Rx.meds from hypertension to PTSD.. I then found 'Ayurveda' and am down to just the original 2 for My broken back/neck. At that time My 'health insurance' was covered and since I've taken care of Myself, and saved $1300/month on prescriptions.. I NOW get charged $1207/month for "Health Insurance"

It is ALL a $¢am.. If they don't get You "here" they will get You 'there'...

I'm very close to continuing My chase of "The American Dream" but just in South America... I'm leaning towards Uruguay.. If the SHTF where would be a bigger target Flori-Duh and dodge HAARP induced hurricanes? or Uruguay ?

Any Uruguayans on-board?

Legalize it, Don't criticize it.. Pete Tosh

What are the conditions of his "probation"? He
gets test for marijuana? As long as he stops
taking it, he stays out of jail?

Make sure he dies?

Sounds like a life sentence to me. Or a death sentence.
Same either way.

a reply to: Swills But it wasn't exactly a win-win for him either. Being a native of Iowa, It looks like he will be forced to travel to Colorado, where MJ is legal, to buy the quality and quantity that he needs for tx.

Greetings- May You have the ability to fulfill Your screen name, and rise like a Phoenix and indeed be a "Free Man".. You should certainly be able to do whatever You and any other consenting adult and/or emancipated minor, should be able to do..

Besides sticking their nose in Your bee's wax, I'll bet Your complainant was/is a 'drunk' that hangs on to the 2nd amendment but screw the other 26. Their "Life" is miserable and because misery is a member of the Lonely Hearts Club, it seeks out those who aren't miserable. You've found a conduit for sanity in a world that is circling the drain. He/She/They have been looking for the answer at the bottom of a 5th..

Because the non tax paying entity we know as the NFL™ has brought Domestic Violence (D.V.) into the spotlight, out of the 100's of calls dispatched to a domestic dispute, the majority were drunk or en route to getting drunk.

I'd type more about it but have a received some warnings about violating the rules but if anyone is in pain and especially "chronic pain" then who else is to say what that person's pain level is? Western Medicine read 'BigPHarma™' would rather get You 2 or scripts as opposed to You growing Your own medicines for FREE. There is no "co-pay" on soil and seed..

One interesting thought considering that we now have mandatory
government funded health care insurance...It is now financially
prudent to allow access to cheap (as in, grow your own) medicine.

Think of it this way, for every dollar the government doesn't have to
spend treating illness because a resourceful citizen took it upon
himself to treat his own illness, means one more dollar into the
coffers of government to use anyway they want.

We may actually be at the tipping point of medical MJ use. But not
because it is a good, effective, treatment for some disease, but
because it saves the government LOADS of cash to spend elsewhere.
