I could see how the 35 year sentence was validated :

Possession in a school zone
Possession in a school zone with intent to distribute
Possession and intent to sell within 500 feet of a public place
Possession within 500 feet of a school zone with intent to distribute
Felony intent to distribute narcotics
Felony distribution of narcotics
Evading arrest
Possible assualt of an officer
Possible felony weapons charges as someone just doesn't have that much green without possessing some type of firearm.

Personal use claim can only used if the amount is less then 1 oz (28.27grams) as anything larger means you intend to sell it. Dude probally had other charges stemming from a previous run in which he did not answer to (like a warrant being issued prior to this arrest that had nothing to do with this action).

Unfortunately anything can be put on the ballot for legalization but all it takes is an act of the State Legislature and whatever was on the ballot becomes circumvented hence when California citizens approved Gay Marriage just to have the Legislature overturn it by a simple vote so as long as that hurdle remains nothing will happen in that regards pertaining to that.

I suppose murder fits into our world paradigm a bit better than pot.

So I guess sentencing harsher for murder makes sense.....


It is sad that that is true, you could deal more damage to "their" world by promoting pot (in whatever sense) over murdering someone.
