It's a possibility...but, fortunately, Defense now has Costello's actual (under oath) testimony to the congressional investigation committee.
They can enter that in evidence after they hit Cohen with it on the stand.

Bragg was also initially given this info. but ignored it...for obvious reasons.

knowing this is as it looks, and there is no crime, I wonder if there are any professional repercussions for charging a case like this, and being this inept at prosecuting it, all while the gag order, and the forcing Trump to be there every day the court is in session? It's so obviously election interference, and also obviouly orchestrated by the White House. If the R's let this go, they are in on it. IMHO
